On August 9, 2005, Governor Linda Lingle, through her Attorney General Mark J. Bennett,
requested the Hawaii County Council to support its efforts to reverse the August 2, 2005,
decision and judgment of the three judge panel in Doe v. Kamehameha Schools/Bernice Pauahi
Bishop Istate, C.A. No. 04-15044. In particular, they requested a statement of support from all
four County Councils in the State of Hawaii. The Attorney General needs these statements by
August 15, 2005, in order to attach such statements to the State's amicus brief in support of the
Kamehameha School's request for a hearing en bane. Given the significance of this court case,
we recognize that this is a truly extraordinary situation that requires suspension of our rules.
Therefore, we, the undersigned Council Members, request that the Council Rules of Procedure
and Organization be suspended in accordance with Rule 20 in order to discuss the attached
resolution relating to the Kamehameha Schools' Suggestion to Rehear the Ninth Circuit Court of
Appeals Decision in Doe v. Kamehameha Schools%Bernice Pauahi Bishop Estate. Specifically,
Rule No. 6(6)(e), relating to committee chair waivers, is requested to be suspended in order for
the resolution to be heard b~ the Council and submitted in a timely fashion.
