A RI:SOLU'IION SUPPORTING EFFORTS TO REHEAR EN BANC TIIE NINIH CIRCUIT
COURT OF APPEALS' DECISION THAT THE ADMISSION POLICY OF TIIE
KAMEHAMEHA SCHOOLS IS RACIALLY DISCRIMINATORY
WHEREAS, anticipating the need to protect her people against the forces building within
the Kingdom of Hawaii that loomed larger and larger as a threat to their continued well-being,
Bernice Pauahi Bishop, with wisdom and foresight, bequeathed the lands she inherited as the
great-granddaughter and last royal descendant of Kamehameha the Great, as the perpetual
endowment for the establishment and support of the Kamehameha Schools, to provide her pcoplc
"first and chiefly a good education in the common English branches, and also instruction in
morals and in such useful knowledge as may tend to make good and industrious men and
women; '
WHEREAS, a three judge panel of the United States Court of Appeals for the Ninth
Circuit has concluded that the Kamehameha Schools' illegally discriminates on the basis of race
in its implementation of Bernice Pauahi Bishop's vision of providing Native Hawaiian children
with an education;
WHERF,AS, the Hawaii County Council believes that the implications of the decision
are far-reaching to our community and the State of Hawaii, and should be heard by the full
Ninth Circuit Court of Appeals.
NOW. THEREFORI?, BE 1T RESOLVED BY THE COUNCIL OF THE COUNTY OF
I IAWAI`I that it supports the Kamehameha Schools' Suggestion for Rehearing En Banc in the
United States Court of Appeals for the Ninth Circuit of the decision and judgment of the three
judge panel in Doc v. Kamehameha Schools/Bernice Pauahi Bishop Estate, C.A. No. 04-1504,4.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii transmit certified
copies of this resolution to thc: Kamehameha Schools/Bernice Pauahi Bishop Estate Board of
Trustees, State Attorney General Mark J. Bennett, the Honorable Linda Lingle, Governor, State
of Hawaii.
