SUBJECT: FLOOD CONTROL AMENDMENT
We have prepared the attached two (2) ordinances for your review and consideration for adoption
of the subject amendment. We are revising some sections of Chapter 27 of the Hawaii County
Code to comply with the minimum requirements of the National Flood Insurance Program
(NFIP) and Related Regulations. The following is a brief description of the two ordinances
proposing to amend Chapter 27.
A) Proposed Ordinance
Section 1 - This section of the proposed ordinance amends the provisions on "Substantial
Improvements", Section 27-12(a)(61), to include buildings constructed after May
5, 1982 which were not within a special flood hazazd azea at the time of issuing
the building permit.
Section 2 - This section of the proposed ordinance amends the provisions of Section 27-13,
"Nonconforming Structures", to include structures existing on May 5, 1982,
made nonconforming by a change in the special flood hazard area.
Section 3 - This section of the proposed ordinance revises Section 27-18, to require floors
for residential new construction and substantial improvements, to be elevated to
or above the base flood elevation. Section 3 of this proposed ordinance also
amends the floodproofing requirements for nonresidential new construction and ~jq,

B) Proposed Ordinance -Amends Article 6 by adding a new section regulating "Encroachment
and/or obstruction over or through any portion of a drainageway,
floodway, levee system or watercourse."

Committee Chair for introduction.
