ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 9, SECTION 24-249, HAWAII
COUNTY CODE 1983 (2005 EDITION), TO PROHIBIT SOLICITING OF VOTES ON OR IN
PROXIMITY TO A ROADWAY.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The County Council finds the policy of permitting political campaigning and
sign waving along roads in the County of Hawaii can lead to inattentiveness on the part of vehicle
operators and distractions to both the drivers and sign-wavers themselves, which could contribute to
vehicle accidents and related injuries or deaths. Prohibiting solicitation of votes along County
roadways will help to ensure the safety of drivers and pedestrians in the County.
SECTION 2. Chapter 24, article 9, section 24-249, Hawai' i County Code 1983 (2005
EDITION). relating to pedestrians soliciting rides or business, is amended to read as follows:
`'Section 24-249. Pedestrians soliciting rides, [e~] business, or votes prohibited.
(a) No person shall stand in a roadway for the purpose of soliciting a ride, employment,
or business from the occupant of any vehicle.
(b) No person shall stand on or in proximity to a street or highway for the purpose of
soliciting the watching or guarding of any vehicle while parked or about to be parked
on a street or highway.
(c) No person shall stand on or in troximity to a street or highway for the purpose of
soliciting votes from the occupant of any vehicle.'"
SECTION 3. Severability. If any provision of this ordinance, or the application thereof to
any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be severable.
SECTION 4. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need
not be included.
SECTION 5. This ordinance shall take effect on its approval.
