SUBJECT: Draft 3 Bill 134 to Provide Enhanced Public Notification of Proposed Development
Enclosed is Drafr 3 of Bill 134 to provide enhanced public notice of proposed development. This
Bill amends Chapter 23 (Subdivision Code), Hawaii County Code. Draft 3 is strictly changes to
structure and format, not changes to substance, content, or intent.
This Bill was amended in the Planning Committee. In Section 23-58A subsection (c), paragraph
(1) was added to read as follows:
"Section 23-58A (c) (1). No pictures or drawings or promotional materials shall be
permitted on the sign."
Section 23-58A subsection (c) relates to Posting of Signs for Public Notification. The above
amendment is as passed in Committee as Draft 2.
On advice of the Legislative Research Branch, Drafr 3 inserts the same amending language ("No
pictures or drawings or promotional materials shall be permitted on the sign.") within Section
23-58A subsection (c), rather than by adding a paragraph.
Draft 3 amends Chapter 23, article 4, division 1, Hawaii county code 1983 (2005 edition) by
adding a new section, to be numbered Section 23-58A, with subsection (c) to read as follows
(Draft 3 change underlined):
'`Section 23-58A subsection (c). Notwithstanding any other provisions of law, the sign
shall be not less than nine square feet and not more than twelve square feet in area, with
letters not less than one inch high. No pictures, drawings, or promotional materials shall
be permitted on the sign. The sign shall be posted at or near the property boundary
adjacent to a public road bordering the property and shall be readable from said public
road. If more than one public road borders the property the applicant shall post the sign to
be visible from the more heavily traveled public road. The sign shall, in all other respects,
be incompliance with chapter 3, Hawaii County Code 1983 (2005 edition)." ' I

paragraph (2) Hawaii County code 1983 (2005 edition) by adding the same provision regarding
signage. This subsection reads as follows (Draft 3 change underlined):
"Section 23-17. (c) (2). Notwithstanding any other provisions of law, the sign shall be not
less than nine square feet and not more than twelve square feet in area, with letters not
less than one inch high. Nopictures, drawings, or promotional materials shall be
permitted on the sign. The sign shall be posted at or near the property boundary adjacent
to a public road bordering the property and shall be readable from said public road. If
more than one public road borders the property the applicant shall post the sign to be
visible from the more heavily traveled public road. The sign shall, in all other respects, be
in compliance with chapter 3, Hawaii County Code 1983 (2005 edition)."
Section 23-17, relating to procedures for variances, was not amended in Committee.
