No. 389/Bill No. 134 PI.ACF.: Council Chambers IIML?: 1:30 p.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 134, reports as follows: Bill No. 134, transmitted by Councilmember Bob Jacobson via Communication No. 389, dated August 4. 200, amends Chapter 23 (Subdivision Code), Hawaii County ('ode, by amending appropriate sections to provide enhanced public notice of proposed development. Bill No. 134 requires a developer or landowner to post a sign of a proposed development on the affected property for subdivision or variance approval pursuant to Chapter 23 (Subdivision Code), I Iawai`i County Cude. Communication 389 reports that the purpose and intent of this bill were previously contained in Bill No. 23, amending Chapter 14 (General Welfare), Hawaii County Code. Bill No. 23 was filed at the July 22, 2005 Hawaii County Council meeting. In response to the Planning Director's recommendation, transmitted in a communication from the Hawaii County Planning Commission dated June 8, 2005, the provisions suggested by Bill No. 23 have now been included in Bill No. 134 as amendments to the appropriate sections of Chapter 23 (Subdivision Code). A companion Bill No. 135 (('omrn. 390) includes amendments to the appropriate sections of Chapter 25 ('Coning Codc). Bills No. 134 and 135, respectively. amend Chapter 23 (Subdivision Code) and Chapter 25 ("boning Code) separately to ensure that the proper technical procedures are followed in making amendments to these ordinances. Norman Hayashi, the Planning Department's representative in attendance at the meeting, verified that Use Planning Department is the enforcing agency for Bills No. 134 and 135 and that the Planning Department supports both measures. Hayashi explained that the two bills will help to ensure that the puhlic is notified when new developments arc proposed in their neighborhoods. Councilman Higa noted that Bill No. 134 did not include language specitically prohibiting commercial uses on the signs. In response to Councilman tliga's concerns, Bill No. 134 was amended to include language to prohibit promotional messages or images on the signs. Section 23-58.A (c) of Bill No. 134 was amended to add subsection (1) as follows: 23-BRA (c) (1) No pictures, or drawings. orpromotional materials shall be permitted on the sign.
