W W 199 DOCKET NO. OS - V W W - 33 Pursuant to H.R.S. §342D-7(i), Hawaii Revised Statutes, the State Department of Health (DOH) seeks written comments from interested persons regarding the following. John Ross and Young Hui Ross of Paauilo, Hawaii have applied for a five (5) year variance from Hawaii Administrative Rules (HAR), Section 11-62-31.1(b)(1) which states that "The director may allow an individual wastewater system other than a cesspool to be used for two dwelling units which may or may not be located within the same building provided: (A) Both of the dwelling units are located on the same single family residential lot; and (B) The individual wastewater system used shall meet the current requirements of this chapter." Mr. Donald Cook, Consulting Engineer, is the authorized agent to act for the applicant. The applicant states the total area of the subject lot is 9209 square feet. The lot has 2 buildings on it, consisting of four one-bedroom apartments. By DOH standards, the wastewater design flow is 4 bedrooms times 200 GPD = 800GPD. However, available water records for the last 24 months show an average use of 545 GPD, with a maximum of 780GPD during the same period. The multiple dwelling is located at 75-180 Ala Ona Ona Street, Kailua-Kona, Hawaii, and identified as TMK: (3) 7-5-022: ] 44. The applicant has made the following comments. a. There are two buildings on the subject lot, each with two dwelling units. Although there are only a total of 4 bedrooms, there are also 4 dwelling units. If more than 2 dwellings are connected to one IWS, then a variance is required by DOH rule. b. The existing large capacity cesspool(s) must be closed and replaced with a new treatment individual wastewater system by April 5, 2005 in order to comply with federal requirements. c. The applicant believes this variance request is in the public interest because the LCC will be upgraded to an IWS (septic system). The IWS plans will be designed by an engineer and will be submitted to DOH for review and approval. The new IWS will provide a better wastewater treatment system compared to the existing LCC. Therefore minimizes impact to the environment. d. The existing LCC will be upgraded to an IWS (septic system). The IWS will provide abetter treatment system prior to effluent disposal. The IWS will be designed and constructed to meet the Department of Health standards. The impact to the environment will be minimized compared to the current wastewater disposal. e. The proposed treatment individual wastewater systems will provide greater protection than the large capacity cesspools. The proposed IWS is an improvement to the existing cesspool in temis of wastewater treatment. The septic tank will provide pretreatment and sludge removal prior to effluent disposal. f The residents of the Downtown Area of Kailua-Kona are essentially economically depressed. g. The existing location of the facility is severely restrictive. There is simply no space to construct a wastewater treatment plant. h. The variance is requested for the maximum of five (5) years. Plot maps have been attached to this application for variance but can not be shown here. The lot has 2 buildings on it consisting of a restaurant and a physical therapy office which are served by a cesspool. The lot has 2 buildings on it, consisting of four one-bedroom apartments. By DOH standards the design wastewater flow will be 4 bedrooms times 200GPD = 800GPD. The installation of a wastewater treatment plant in lieu of a septic system will not be possible due to space restrictions and may force the owner to abandon the business operation. Septic tanks shall be inspected on a yearly basis by opening the access cover and checking if ether the sludge cr scum is near the outlet pipe. i 2. The septic tank shall be cleaned out if either: (a) The bottom of the floating scum mat is within three inches of the bottom of the outlet pipe; or (b) Sludge comes within six inches of the bottom of the outlet pipe. 3. Cleaning the septic tank shall consist of pumping the contents into a tank truck and hauling it to a State Health Department approved point of disposal. The septic tank shall not be washed or disinfected after pumping. A three-inch depth of residual sludge shall be left in the tank for seeding purposes. 4. Aseptic tank shall not be entered by anyone unless proper safety procedures are followed. There is a potential hazard of explosion of gases and f or asphyxiation of personnel if precautions are not taken. 5. Chemicals or disinfectants do not improve the operation of septic tanks and are not recommended. Ordinary chemicals used in the household in small quantities will not adversely affect the operation of the septic tank. 6. Paper towels, newspaper, wrapping paper, rages, and sticks should not be flushed into the septic tank. They will not decompose and will lead to clogging of the piping. 7. Improper operation and maintenance of the septic tank will lead to early failure of the disposal system (absorption beds, seepage pits, etc.) by clogging the piping and adjacent soil.
