AN ORDINANCE AMENDING CHAPTI~R 18, OP THE HAWAII COUNTY CODS 1983 (2005 EDITION), RELATING TO PUS~IC TRANSPORTATION. SE IT ORDAINED DY THE COUNCIL. OP THIS COUNTY OP HAWAII: SECTION 1. Chapter 18, Article Division 1, Section 18-90, (Pares), of the I-fawai`i County Code 1983 (2005 edition), is amended by adding a new subsection to read as follows: (h) [Transportation kokua zone. (1) The purpose of this subsection is to boost ridership in economically depressed districts and to assist in alleviating traffic congestion in various districts. The council may, upon consultation with the transit administrator, establish a transportation kokua zone. Riders boarding and alighting any public transit vehicle operated by the County of Hawai' i or its designee within a transportation kokua zone shall ride free of charge. (2) The following areas shall be designated a transportation kokua zone: (A) The "Kona district zone" between Hawaiian Ocean View Estates/Hawaiian Ocean View and Kawaihae. (E3) The "Puna district zone" between Pahoa and Hilo.] (h) Island-wide transportation free zone (1) The purpose of this subsection is to provide the public with a transportation alternative to the private automobile. The provision of an effective public transportation system for the residents of the County of Hawaii will produce economic, social and lifestyle benefits for the residents of Hawaii County. The distances residents must travel for work, medical, education, and social needs will be alleviated by providing public transportation at no cost to the user. (2) The County of Hawaii shall be designated a transportation kokua zone. Riders boarding and alighting any regularly scheduled bus route operated by the County of Hawaii or its designee shall ride free of charge. SECTION 2. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 3. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. This ordinance shall take effect upon its approval.
