This later will confirm your conversation with Darya Arai of our Wcst Hawaii Office. regarding
r the abovo-deasaibcd SMA Use Permit No. 276 and the proposed development of a 48-amt
~ condominium project on rho subject property. This conversation took place sonic lima during
the last week of March 2001.
Effective January 9, 1989, the Platmiag Commission issued SMA Use Permit No. 276 to allow
the development of a 48-unit condominium project on the subject prope:ty subject to wnditions
of approval. Final Plan Approval for the proposed developmert was issued by thie ofl9ce on
November 30, 1990 and a building permit was issued on January 25,1991 in compliattce with
conditions of approval. The proposed cvmdominir~ project was never constructed.
By letter datod February 10,1999 to Libby ICemiatrgi, we confirmed the validity of SMA Use
Permit No. 276, provided that a review of say changes to the physical con5gmratioon of the
proposed project be conducted by the Kaiw Village Design Comroiwion. Such roview occurred
on April 13, 1999, with the Kailas Village Design Commission voting to recomm~d its
approval subject to conditions.
In direct rosponse to your question, SMA Use Permit No. 276 remains valid and will permit the k
wnstrnction of a 48-unit condominium development and its related improvemoots provided that ~
the scope of the project is generally consistent with the scope of improvements approved by the ~'j
Piatming Commission in 1989. If the building desigm and building mrvelope generally remains
the same as originally repressmted, rhea we would bad that the construction of such a building is

apologize for the delay in responding to your letter and appreciate your patience.
Your l~xttr lists soma of the hardships that raay be experienced by the hutdowuer sFlould the
ttacesa uylight-of--way be delineated within a portion of the subje<;t property to accommodate the
ptoposod oxteosion of Nani Kailtta Drive. In consideration of these pounGal hardships, your
letter requests the following "cotlsideration and approval" from the Planning Dtpartmeat:
1. A change of zone of the subject prolraty from its currrat decugttation of RM-1 to a
CV-7.3 zoned district; (note: yotu letter ineotrwtly l~eftmed to a CV-.75 zrnted dishier)
2. Permitting a maximntn stnrctnlsl height liatit of 90 feet:
3. Allowing for a maximum unit count of 78 traits as may be permitted by a zoning of
C V.7. S;
a. The right to purchase additional water units to accommodate 78 traits atul ancillary uses
such as irrigation, pool :utd spa; and

I would be supportive of a change of zone of the subject paroperty from, an RM-1 ro a CV-7.5
zoned district. Such a change in zoning would ba consisteW with our land use policies for the
errs as detailed by the General Platt and 17te Master Piaot for Kailas-Kona Howovar, please
note that a change ofzoue to a CV-7.S zoned disaiet woWd not allow for ffit increase in unit
count to the 78 runts tegtteeted, but limited to a mattimttm of40 tuba. A CV-zoning also has a
maximum height limit of 30 feet. I would recommend a Resort (V) zoning classification that
would prnnit a mazitnttat unit density of 750 square fed of latad erns pea unit for a total of 66
units lwssible vn the subject properly. No type of caning exists that would aecotmraodate your
request for a total of 78 tmia oa the propotty. My support of a Resort (V}zoniag for this subj act
prapetty is cotttittgent upon dedication of that pattioat of the subject property necessary to
aceotnmodate the extension ofNaai Pallas ]?diva n no cost ro the County.
I will nut support any request lbr a variance ro allow for a martlmrua structural height in excess
of the forty-hue (45) foot height limit pcbcmitted within both tiro Multiple-PanrilY (RM) sad
lusort (V) coned districts. For yotu iafarwation, CV-zoned disaicts have a maximum her Erin
limit of 30 foot. My position not ro support a variance is based vrt a amendment to the Zoning
Cody adopted last yoax to seduce the mttximttm height permitted oa General Commercial (CG)-
zoned lands within cettaitt portions of t\iorth Kona from 90 feet to 45 feet. To approve an
administrative variance to allow a building to exceed a height of 45 feet would ire toutrary ro the
intent of the County Council to trot allow any sauctttre within Kailua-Kona to exceed 4S fee.

with a reprascntativc of We pepartment of Water Supply on Apti130, 2003 indicates that water
to accnanmodate a maximum of 68 units can be utsde available to the subject property, subject w
water availability anti the aced ro provide systturr improvements, which may include innsasiug
the size of the water line servicing the subject property .firotii its cutrrnt 6 inches to 12 incites.
The necessary water cvtntuitmenr payment mast also be made. We encourage your client to
contact the Depazaaemt of Water Supply to corlfirm the availability of additional wafer
cottttttitmcnts and obtain iaformatiat regarding necessary water systertt improvements.
Frrrally, we would ]taut no objection ro the use of that portion of the subject property within the
proposed alignment of Mani Kailua Drive for tentporaty patltittg until such time road
construction commences. However, please be mindful that required parking at a ta[io of
1.?S stroll per unit must be provided on the subject property, We would be willing to entertain a
variance to provide some limited relief to the parking reyuiretnmts and standards, but the
