Your Committee un Planning. to which was referred Bill No. 140, reports as follows:
Bill No. 140, transmitted via Communication No. q09 from Mayor Flarry Kim, dated
August 1 K, 2005, presents a Change ofzone request by Craig and April Nakagawa, at Waiukea
I lomestcads, 1'' Series. South Hilo, Hawaii. TMK: 2-4-9:26.
Bill No. 140 seeks to amend Section 25-K-33 (City of Hilo Gone Map). Article 8, Chapter 25
(zoning Code) of the Hawaii County Code, by changing the District Classification of
approximately 27,224 square feet of land from Single-Family Residential -15,000 square feet
(RS-15) to Single-Family Residential -10,000 square feet (RS-10).
Communication No. 409 reports the Hawaii County Planning Commission, as required by the
Hawaii County Charter, Chapter 4, Section 6-43(C), considered this rezoning request and
accompanying Bill No. 140 on August 5. 2005. The Commission concurred with the Alarming
Directors favorable recommendation on this matter. The Planning Director's tindings and
recommendations, transmitted with Communication No. 409, can be summarized as follows:
I . 'fhe applicants are the owners of the property. The applicants are requesting a Change of
zone liir approximately 27,224 square feet of land from the Single-Family Residential -
15.000 square feet (RS-I S) district to Single-Family Residential -10.000 square feet
district to allow atwo-lot subdivision.
2. The subject property is located on the east side of Maikai Street in the Waiakea
Homesteads area of South Hilo. Access to the site is from Maikai Street, a County road
with aright-oi=way width of 40 feet and a pavement width of 18 feet.
3. 'fhe applicants arc requesting the Change of Zone so that they may subdivide the property
into two residential lots. One lot will be approximately 10,032 square feet in size and will
retain the existing 73-year old single-family residence. The second lot will be
approximately 17.192 square feet in size; the applicant proposes to construct a new rental
dwelling on this lot if the rezoning request is approved.

4. 'I~hc approval of the Change of Zone request from the Single-Family Residential -
15,000 square feel (RS-I 5) zoned district to Single-Family Residential -10,000 square
feet zoned district would result in an appropriate land use pattern that will further benefit
the public based on the following:
• "I~he proposed change of zone is located in an area designated in the General Plan to
allow single-family residential uses. Surrounding properties are zoned RS-15 and
RS-10: thus the proposed change of zone complements existing land uses in this area.
• The action also complements the Land Use and Housing elements of the General Plan
by providing residential uses in urban areas with adequate public utilities and facilities
in locations with convenient access to shopping and employment centers. Within one-
halfmile of the subject property are various restaurants, shopping centers, churches.
schools. and convenience stores.
• ~fhe proposed rezoning conlorms to the I.UPAG map which designates the area for [,ow
Density Urban Development.
• All essential services and utilities are available to the project site.
• The Federal Emergency Management Agency's (FEMA) Flood Insurance Map (FIRM)
identities the site as "X" or outside the flood plain.
5. Requisite of the Planning Director's favorable recommendation for the C hange of lone
rrqucst are tourtcen conditions contained in Bill No. 140 that outline specific
requirements for the proposed project. These conditions require restrictive covenants in
the deeds of both proposed lots to prohibit the construction of a second dwelling unit and
condominium property regimes on each lot.
Communication 409.1 from I lawai'i County Planning Director Chris Yuen, dated August 30,
2005, was circulated to amend Bill No. 140 by adding standard language contained in Section 3
regarding invalidity of ordinances. Draft 2 of Bill No. 140, which includes Section 3, will be
forwarded to the County Council prior to first reading.
Your committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of the Change of 7.one request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 140 and
recommends it pass first reading.
