SUBJECT: Resolution to Allow Use of Fair Share Contribution Off Site
Enclosed are a Resolution and a Request for Council Action for the Council's consideration. Please
assign it to the committee you think would be most appropriate. Possible assignments might be to the
Finance, Planning or Public Safety and Parks and Recreation Committees.
Phil Tinguely of Tinguely Development has graciously offered to construct three outdoor basketball courts
at Kailua Park near the Kekuaokalani Gymnasium in Kona. He would like the Fair Share Assessment fees
due on a 34-unit subdivision to be applied to this project. We expect that the actual cost of constructing
the courts will exceed the fair share assessment of $132,931.40. We expect to enter into an agreement
with Mr. Tinguely which will assure the timely completion of the courts and the construction according to
specifications earlier delivered to Parks and Recreation by Mr. Tinguely.
Mr. Tinguely is anxious to start the construction. Your expeditious review of the resolution will assure that
he is not kept waiting. We took a while to determine how this should be done since it is a first for many of
the staff members involved.

A. REQUEST:
Phil Tinguely of Tinguely Development, Developer of Kaha'olino, a 34 unit subdivision in Kalao`oa North
Kona, has asked that his Fair Share Assessment be allocated to Outdoor Basketball Courts at Kailua Park
(the County's side of Ofd Airport Park in Kona). Condition K of Tinguely's change of zone ordinance 02-62
calls for a fair share assessment of $132,931 for Parks and Recreation. The construction and materials
costs are expected to exceed that amount and more to install the three courts he is proposing.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Chris Yuen, Planning Director, finds this payment of in-lieu fees acceptable as long as P&R likes the idea.
We like the idea. He advises, however that Council approval is required since these improvements are off-
site. Mr. Yuen suggests a resolution accepting the court costs in lieu of payment to the County of Mr.
Tinguely's fair share assessment.
