RESOLUTION NO. 186 05
RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO DISPOSE OF DONATED
LANDS SITUATE AT SOUTH HILO, HAWAII, BEING TAX MAP KEY:(3)2-3-030:004, BY
EITHER PUBLIC AUCTION, SALE OR LEASE BY SEALED BID, SALE OR LEASE BY
NEGOTIATIONS OR EXCHANGE .
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii owns a 60.59 acre parcel of land in the South Hilo
District, County and State of Hawaii, near Kilikina Street, identified as Tax Map
Key: (3)2-3-030:004 (Exhibit "A"); and
WHEREAS, the director of finance has established a "Land Management Committee,"
comprised of County personnel with expertise or interest in the County's management of its
real property resources, for the purpose of reviewing County land management issues and
making recommendations to the director of finance; and
WHEREAS, the director of finance and the members of the Land Management
Committee consider this parcel to be surplus and that disposition of this parcel would be in the
best interest of the County; and
WHEREAS, flexibility in disposition of County property will allow the greatest possibility
to maximize return value, and thereby be in the best interests of County; and
WHEREAS, pursuant to Section 2-112, Hawaii County Code, the County Council may
direct the director of finance to dispose of real property by public auction or other methods
where it finds a substantial reason to do so; and
WHEREAS, pursuant to Section 2-113, Hawaii County Code, the director of finance
may dispose of County property by sale or lease by sealed bids; and
WHEREAS, pursuant to Section 2-114, Hawaii County Code, real property may be sold
or leased through negotiations upon finding by the Council that public interest demands it; and
WHEREAS, pursuant to Section 2-115, Hawaii County Code, real property can be
exchanged for a public purpose; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that disposal of Tax Map Key: (3)2-3-030:004 by the most efficient and financially
responsible method is in the public interest and serves a public purpose.
BE IT FURTHER RESOLVED, that the County Council finds that there is substantial
reason not to restrict disposition of Tax Map Key: (3)2-3-030:004 by public auction and to
allow the director of finance to employ all lawful methods of disposition of this parcel.
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to (1) Mayor
Harry Kim; (2) Director of Finance William Takaba; (3) the Land Management Committee; and
Real Property Tax Administrator Wes Takai.
