AN ORDINANCE AMENDINU CHAPTER 15, ARTICLE 1, SECTION 15-7, OF THE
HAWAII COUNTY CODE 1983 (2005 EDITION), RELATING TO PARKS AND
RECREA"I10N.

SECTION I. The purpose of this measure is to amend chapter 15 (Parks and
Recreation) by changing the imprisonment penalty from ninety days to thirty days. Possible
penalties will remain, imposition of a Yine, imprisonment. or the imposition of both a fine and
imprisonment.
SECT"ION 2. Chapter I5, article 1, section 15-7, of the Hawaii County Code 1983
(2005 Edition), is amended to read as follows:
"Section ] 5-7. Penalty.
Any person convicted of violating any provision contained in this chapter shall be
punished by a fine not exceeding $ I ,000 or by imprisonment not to exceed [ninety] thirty days,
or both, and shall he adjudged to pay all costs of the proceedings. In addition to the penalties
provided herein, the County may recover for damages to its property, the measure of which shall
be the cost of repairing, replacing, or rebuilding the property injured or destroyed."
SECTION Material to be repealed is stricken and bracketed. New material is
underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need
not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
