This bill was originally brought forward from the Environmental Management Commission. Littering and illegal refuse disposal are crimes of convenience to avoid payment of fees and to shift the private costs and responsibility for private waste onto the wider community. This bill toughens penalties for littering and illegal refuse disposal. Your Environmental Management Committee, at its October 4, 2005 meeting discussed Draft 1 of this bill, and postponed the bill for 4 weeks to permit rewriting of penalty language. The Prosecutor's Office and the Department of Environmental Management have worked with Council staff on Draft 2 to meet the goal of making littering and illegal dumping of refuse a more serious offense, with more serious consequences for violators than is now the casrr. Changes to penalties for littering violations are: 1. The option of community service is removed; and 2. Each day of violation constitutes a separate offense. Changes to penalties for illegal refuse disposal are: 1. 'the maximum fine is increased to $1,000 for each violation; 2. Imprisonment is added, with a sentence of up to 30 days for each violation; 3. A sentence of both fine and imprisonment (combination of 1 and 2 above) is added; 4. The option of community service is removed; and 5. Each day of violation constitutes a separate offense.
