Yi ^F• r` RESOLUTION NO. 196 U5 RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO CONVEY LANDS SITUATED AT MANOWAI`OPAE HOMESTEADS, NORTH HILO, HAWAII, BEING TMK: (3)3-6-003:035 TO THE DEPARTMENT OF WATER SUPPLY FOR WELL AND RESERVOIR EXPANSION. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: WHEREAS, the County of HAWAII acquired TMK: (3)3-6-003:035, situated at Manowai'opae Homestead, North Hilo, Hawaii, from Yamada Enterprises, Incorporated, a Hawaii corporation, by deed dated June 12, 1968, and recorded in Liber 6124, Page 362; and WHEREAS, the stated purpose for this conveyance to the County was for the use by the Board of Water Supply of the County of Hawaii for the Laupahoehoe Water System; and WHEREAS, the Department of Water Supply owns the adjacent parcel, TMK: (3)3-6-003:036, situated at Manowai'opae Homestead, North Hilo, Hawaii; and WHEREAS, the Department of Water Supply uses this adjacent parcel as a well and reservoir site; and WHEREAS, the Department of Water Supply desires to consolidate these parcels and expand its well and reservoir site onto the County parcel, TMK: (3)3-6-003:035; and WHEREAS, the Director of Finance considers this parcel to be surplus and that disposition by quitclaim to the Department of Water Supply for its stated purpose would be in the best interest of the County; and WHEREAS, pursuant to Section 2-120(b), Hawaii County Code, an appraisal is not required on disposition of real property to governmental agencies; and WHEREAS, pursuant to Secti^n 2-120(x)(1), Haw~,i`i County Code, the Council may by resolution authorize the Director of Finance to directly sell this parcel to the Department of Water Supply in fee simple. NOW, THEREFORE, ICE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAVVAI`I, that disposal of TMK: (3)3-6-003:035, situate at I`Jlanowai'opae Homestead, North Hilo, Hawaii, by direct sale to the G'-apartment of Water Supply via quitclaim deed is in the public interest and serves a public purpose. BE IT FURTHER RESOLVED that copies of this Resolution be transmitted to: (1) Mayor Harry Kim; (2) Director of Finance William Takaba; (3) the Land Management Committee; and (4) Milton Pavao, Manager of the Department of Water Supply.
