The State of Hawaii, et. al. CIV. NO. 05-1-0315 Request for Executive Session Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended (hereinafter "HRS"), the Office of the Corporation Counsel respectfully requests the above matter be agendized at the meeting of the Hawaii County Council on November 9, 2005, for confidential attorney-client discussion. We make this request as we anticipate discussion on questions and issues pertaining to the Hawaii County Council's powers, duties, privileges, immunities, and liabilities. The discussion will also cover the County's involvement in pending or upcoming litigation regarding this issue. My attorney work product will be produced in advance of the meeting under confidential cover, and will be discussed at this executive meeting. We ask the following descriptive verbiage be included in the Council's agenda under the topic heading: The purpose of the executive meeting is to discuss the Corporation Counsel's interpretation, work product, and recommendations concerning G9mm. Higa October 28, 2005 Page 2 the litigation in this case, existing conflicts of interest with respect to proposed special counsel, and a possible waiver of the conflict of interest, which necessarily involve discussion concerning the Council's powers, duties, privileges, immunities, and liabilities thereto. This meeting is closed to the public pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended. Thank you for considering this request. I will be out of the County of Hawaii on November 9, 2005. Litigation Division supervisor Joseph K. Kamelameha has been the lead litigation attorney in this case on behalf of the County, and will be present to address these issues and answer any questions you may have.
