RESOLUTION AUTHORIZING THE DIl2ECTOR OF THE DEPARTMENT OF PUBLIC W ORKS TO
REMOVE ONE MANGO TREE FROM THE POHOIKI GROVE OF MANGOES DESIGNATED AS
EXCEPTIONAL TREES FOR CONSTRUCTION OF AN INTERSECTION AT
PAHOA-POHOIKI ROAD AND KAIMLJ-KAPOHO ROAD
WHEREAS, the grove of mangoes, Mangifera indica, adjacent to Pohoiki Road, TMK (3) 1-3-08,
owned by the County of Hawaii, is designated as exceptional trees pursuant to Chapter 14, Article 10, Section
14-65, Number 26, Designated Exceptional Trees, Hawaii County Code, and is also referenced as exceptional
trees in the County of Hawaii General Plan, February 2005, Chapter 7, Section 7.5.1, Natural Beauty, District
of Puna; and
WHEREAS, this grove has approximately six hundred (600) mango trees according to an Environmental
Assessment, dated September 2005, completed under the supervision of the Department of Public Works; and
WHEREAS, the Department of Public Works is working on the "Pohoiki Bypass Project," which
involves realigning approximately half a mile of the Kaimu-Kapoho 12oad in order to bypass an area which has
become increasingly flooded during high tides and is sinking almost one inch per year; and
WHEREAS, the °Pohoiki Bypass Project" will relocate a section of the Kaimu-Kapoho Road
approximately 800 feet northwest (mauka), bypassing Isaac Hale County Park, and will help maintain and
improve a vital transportation and evacuation link for the district of Puna, enhance the safety and quality of
Isaac Hale Park, and decrease undesirable effects on wetlands; and
WHEREAS, the "Pohoiki Bypass Project" includes construction of an intersection at Pahoa-Pohoiki
Road and Kaimu-Kapoho Road, which will require removal of one (I) mango tree on the Kapoho side of the
road because this one tree is directly on the centerline of the proposed intersection; and
WHEREAS, this proposed intersection cannot be shifted without severely compromising the sight
distance and efficiency of the intersection for larger vehicles such as boat trailers, or in the alternative affecting
even more mango trees, and
WHEREAS, the county's Arborist Advisory Committee at its regular meeting on October 20, 2005
recommended the County Council approve the Department of Public Works' request to remove the one (1)
mango tree, with the caveat that this shall not set any precedent for the removal of any other tree in the grove;
and
WHEREAS, there is no procedure in the Hawai`i County Code Chapter 14, Article 10, nor the Arborist
Advisory Committee's Rules of Practice and Procedure to regulate removal of a portion of trees from a grove of
exceptional trees, thus authorization by the County Council is sought; therefore
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Department of
Public Works or its authorized agent is hereby authorized to remove one (1) mango tree located in the center of
the proposed intersection of the Pahoa-Pohoiki Road and the Kaimu-Kapoho Road from the grove of mangoes
adjacent to Pohoiki Road identified as exceptional trees.
BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the Director of the
Department of Public Works, the Director of Planning, and the Chairperson of the Arborist Advisory
Committee.
