Subject: Administrative Time Extension to Comply With Condition C

This is in response to your letter dated October 1 1, 2005 requesting an administrative extension
of time in accordance with provisions of Condition O to comply with the Condition C (secure
Final Subdivision Approval within S years) of Change of Zone Ordinance No. 99 1 16.
Condition O allows for an administrative time extension for a period not to exceed the period
originally granted. According to the letter submitted, there is reasonable and sufficient
justification to allow for the requested time extension. The effective date for Change of Zone
Ordinance No. 99 1 I G is October 22, 1999. Therefore, as requested, we will grant a 5-year time
extension until October 22, 20(19 to comply with Condition C

I am writing this letter to request a time extension to Ordinance 99-116.
Because of the uncertainty of the commercial activity in Hilo, I have not
been able to develop a master plan to consolidate and re-subdivide the
property.
