Request: A-20a to Agricultural Project District
Subject: Administrative Time Extension to Comply With Condition E
Tax Map Key: 9-Ei-5:18 and 9-6-fi:4
This is in response to your letter dated October 14, 2005 requesting an administrative time
extension in accordance with the provisions of Condition P to comply with Condition E (submit
detailed site plan) of Change of Zone Ordinance No. 04 120. Condition P allows for an
administrative time extension for a period not to exceed the period originally granted. According
to the letter submitted, there is reasonable and sufficient justification to allow for the requested
time extension. 'The effective date for Change of Zone Ordinance No. 04 120 is November 8,
2004. Therefore, as requested, we will grant a I-year time extension until November 8, 2006 to
comply with Condition E.

RE: Request for Time Extension of Ordinance Amendment Changing
Classification of Agricultural (A-20) to Agricultural Project District per Bill
Number: 249; Ordinance Number 04 120; Effective Date November 8, 2004.
Dear Mr. Yuen:
l am respectfully requesting an extension of the one-year time frame from date of
approval (11-8-04) for submission of the above referenced APD Site Plan for the
following reasons:
1. I have had a most difficult time finding a licensed surveyor to provide
survey services on a timely basis. After contacting several firms, all of who
told me it would be 2006 before they could schedule time. (lima Survey
based in Kona agreed to survey the land. He planned to start by
September 1 but just began the work, October 10, which is getting close to
the one-year deadline as required by County Council to submit the first
site plan. With a deadline of Nov 8, 2005, it is prudent to request aone-
yearextension as provided for in Ordinance: 04-120.
2. The request for a time extension is not contrary to the General Plan or
Zoning Code.
3. The time extension is not contrary to the original reason for granting the
APD.
4. The time extension, if granted, will not exceed the period of time provided
for in the request (one additional year).
I would appreciate a review and approval of this request so that we can proceed
with the project on a timely basis without pressure to meet a deadline that is
close at hand and due to delays beyond our control.
