RESOLUTION NO. 2(i2 U5
A RESOLUTION REQUIRING THE COUNTY OFFICE OF ELECTIONS TO
PROVIDE CANDIDATES FOR PUBLIC OFFICE WITH A COPY OF ORDINANCE
NO.04-142 (HAWAI`I COUNTY SIGN CODE), SECTION 3-7(A), SIGNS PROHIBITED
IN ALL DISTRICTS.
WHEREAS, Hawaii County has an average motor vehicle-related fatality rate three
times higher than the City and County of Honolulu and two times higher than Maui and Kauai
Counties, as evidenced by the Motor Vehicle Crash Fatality Reduction Group Data Summary,
dated 2003, sponsored by the North Ilawai'i Outcomes Project; and
WHEREAS, a Junc 2004 summary report prepared by the North Hawaii Outcomes
Project notes that the motor vehicle-related deaths for the first quarter of 2004 are nearly two
times higher than the first quarter of 2003; and
WHEREAS, Hawaii County has the highest rate ofinjury-causing motor vehicle
crashes in the State when calculated both by population and by vehicle miles traveled; and
WHEREAS, the practice of political campaigning and sign waving along roads in the
County of Hawaii can lead to inattentiveness on the part o1 vehicle operators and distractions to
both the drivers and sign-wavers themselves, which could contribute to vehicle accidents and
related injuries or deaths.
NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii
that, effective immediately, the County Office of Elections must provide each individual who
files for elective office with a copy of Section 3-7, Hawaii County Code 1983 (2005 Fdition),
Signs prohibited in all districts. Specifically, prospective candidates should be made aware that
according to Section 3-7:
"Section 3-7. Signs prohibited in all districts.
(a) No person shall erector maintain:
(1) Any sign which by reason of its size, location, movement, content,
coloring or manner of illumination, constitutes a traffic hazard or a
detriment to traftic safety by obstructing the vision of drivers, or
by obstructing, or detracting from the visibility of any officia]
traffic control device, or by diverting or tending to divert the
attention of drivers of moving vehicles from the traftic movement
on the public streets and roads;"
BE IT FINALLY RESOLVED that the County Clerk of the County ofllawai`i shall
transmit copies of this Resolution to the Office of the Governor, to the Office of the Mayor, and
to the offices of all Federal, State, and County elected officials who represent constituents on the
Island of Hawaii.
