SUBJECT: Rescindment of Donated Properties
Kalapana Sea View Estate Unit I, Keekee-Kehena, Puna, Hawaii
TMK: (3) 1-2-34:78 and 94
On February 7, 1996, the County Council of the County of Hawaii passed Resolution 249-96
authorizing the acceptance of a donation of real properties, Tax Map Keys: (3)1-2-034:078 and 094,
from Mr. Daniel Isami Funakoshi. At the time of the passage, Mr. Funakoshi believed that the
subject parcels were inundated with lava and of no foreseeable use. In compliance with Resolution
249-95, Quitclaim Deeds conveying the two parcels to the County of Hawaii were prepared and filed
with the Bureau of Conveyances on July 11, 1997. However, in preparation for the auction of these
parcels, it was found that while the Kalapana Seaview Estates in general is inundated by lava, these
parcels are not as originally believed. When notified by the Department of Finance, Mr. Funakoshi
expressed a desire to have the parcels returned to him and agreed to pay the back taxes.
Enclosed is the resolution to rescind resolution 249-96 for the acceptance of Daniel Isami Funakoshi
donation of real properties, TMK: (3) 1-2-34:78 and 94 and authorize the Mayor to convey the said
real properties back to him.
