RESOLUTION RESCINDING RESOLUTION 249-96 AU"fHOR[ZING THE ACCEPTANCE OF
THE DONATION OF REAL PROPERTIES FROM DANIEL ISAMI FUNAKOSHI, TAX MAY
KEYS: (3)I-2-034:078 AND 1-2-034:094, AND AUTHORIZING THE MAYOR TO CONVEY
SAID REAL PROPERTIES BACK TO DANIEL ISAMI FUNAKOSHI.

WHEREAS, on February 7, 1996, the County Council of the County of Hawaii passed
Rcsolutiou 249-96 authorizing the acceptance of a donation of real properties from Daniel Isami
Funakoshi, Tax Map Keys: (3)I-3-034:078 and 094; and
WHEREAS, at the time of die passage of Resolution 249-96, Mr. Funakoshi believed that the
subject parcels were inundated with lava and of no foreseeable use; and
WHEREAS, in compliance with Resolution 249-96, Quitclaim Deeds conveying the two
parcels to the County of Hawaii were prepared and filed with the Bureau of Conveyances on
July 11, 1997; and
WHEREAS, in preparation for the auction of these parcels, it was found that while the
Kalapana Seavicw Estates in general is inundated by lava, these parcels are not inundated by the lava
as originally believed; and
WHEREAS. when notified by the Department of Finance that Tax Map
Keys: (3)1-2-034:078 and 094 were not inundated by lava, Mr. Funakoshi expressed a desire to have
the parcels renirncd to him; and
WHEREAS, Mr. Funakoshi has agreed to pay the back taxes totaling $1,920.44 ($960.22 per
parcel).

1-~~1~'~~I'I, that Resolution ?~~-96 is herehy rescinded and the Mayor is hereby authorized to convey
Tai Map Kees: (~}I-?-O3-~-078 and 094 back to Daniel Isami Futlakoshi by Quitclaim Deeds.
