SUBJECT: Bill to amend Ordinance No. OS 85, regarding the Public Access, Open Spaca~ and
Natural Resources Preservation Commission
The changes made by this amendment have been strongly recommended by Corporation Counsel
staff responsible for legal assistance to this commission.
Drafted by Corporation Counsel staff, this bill adds language to Ordinance No. OS 85, regarding
commissioners' terms on the Public Access, Open Space, and Natural Resources Preservation
Commission.
Hawaii County Charter section 13-4 (regarding Boards and Commissions) applies, by default, in
cases of Commissions created by charter. IIowever, the Public Access, Open Space, and Natural
Resources Preservation Commission was created by ordinance rather than by charter. As a result,
the necessary language describing the commissioners' terms was inadvertently omitted from the
ordinance. 'T'herefore, the appropriate language taken directly from section 13-4 of the Charter is
used as the basis of the attached bill that amends Ordinance No. OS 85.

Public Access, Open Space, and Natural Resources Preservation Commission
Pursuant to Section 2(g) of Kule 4 of the Rules of Procedure of the Council of the County
of Hawaii, this written request is submitted with my approval that the above-referenced
matter be waived from the Finance Committee to the full Council for immediate action.
In reviewing this matter, timely approval is crucial It is therefore advantageous that
approval is granted and the matter is placed onto the next Council agenda for review.
However, in the event this request is denied, for whatever reason, I understand the matter
shall be referred to the Finance committee for placement on its future agenda.
