Your Committee on Planning, to which was referred Bill 158, which amends Chapter 25,
Article 8 relating to the City of Hilo Zone Map, reports as follows:
Bill No. 158, transmitted by Communication No. 465 tiom Mayor Harry Kim, dated
September 20, 2005, presents a Change of Zone request by applicant Johanna Leaird
Revocable Living Trust, of property located on the west side of Wainaku Street, adjacent and
north of Dodo Mortuary, Puueo, South Hilo, Hawaii, bearing TMK designation (3) 2-6-8:
portion of 22.
The purposes of Bill No. 158 are the following:
I . To change the district classification from Multiple Family Residential 1,000 square
toot (RM-I) to a Multiple Family Residential 10,000 square foot (RM-10) district;
and
2. To comply with a condition in a previous Change of Zone (Ordinance No. OS-105)
requiring the applicant to rezone the remainder of the property from RM-I to RM-10,
thereby preventing split-zoning of the property.
Communication No. 465 reports the Hawaii County Planning Commission, as required by
Chapter A, Sec. 6-43(C). Hawaii County Charter, considered this Change of Zone request
on September 2, 2005. The Planning Commission found the request to reclassify the subject
property would result in an appropriate land use pattern and recommended a favorable
consideration to amend Section 25-8-33 (City of Hilo Zone Map) of the County Zoning
Code.
Communication No. 465 also transmitted the County of Hawaii Planning Departments
recommendation and accompanying Bill No. 158, which is summarized as follows:
I . Applicant is the owner of the property and is requesting a Change of Zone for
approximately 0.55 acre of land from a Multiple Family Residential 1,000-square foot
(RM-1) to a Multiple Family Residential 10,000 square foot (RM-10) district in
compliance with Condition B of Change of Zone Ordinance No. 05-105. Applicant is
proposing to develop atwo-story residence (pole house), a Japanese Tea House with

Bath House and amulti-story unit with five bedrooms for a Bed and Breakfast
operation for blind and disabled visitors and offer ADA (American Disabilities Act)
lodging and educational classes.
2. The applicant recently conducted a land exchange with Kamehameha Schools that
required State Land Use Boundary amendments and change of zones for both
properties involved in the exchange, at which time the Planning Director
recommended that a portion of the applicant's property be rezoned to RM-10 instead
of RM-I . The RM-10 zoning would prevent a larger development in the area not
suitable for apartments or condominiums. A condition was added in the previous
Change of Zone (Ordinance No. OS-105) requiring the applicant to rezone the
remainder of the property from RM-l to RM-10 to prevent split-zoning of the
property.
3. The proposed Change ofZone from RM-I to an RM-l0 zoned district will conform
to, among others, the goals, policies and standards of the General Plan Elements and
would result in an appropriate land use pattern that will further benefit the public
based on the following:
• The proposed request conforms to the LUPAG (Land Use Pattern Allocation
Guide) Map, which designates the project area as Medium-Density Urban Area.
• The project site is situated within close proximity to schools, commercial areas,
employment centers and public safety services.
• All utilities and services are available to the property.
• There is no severe geological or topographical problems for the property that
cannot be properly rectified or which would render land unusable. The project
area is within Zone X, an area determined to be outside the 500-year flood plain.
• The request is not contrary to Chapter 205A, Hawaii Revised Statutes, relating to
Coastal Zone Management Area.
The request will not have a significant adverse impact to traditional and
customary Hawaiian Rights.
4. Requisite of the Planning Director's favorable recommendation for the change of
zone reyuest are 14 conditions contained in Bill No. 158 that outline specific
requirements for the proposed project. Conditions include requirements that
construction be completed within tive (5) years, the proposed development comply
with Landscaping Requirements of Planning Department's Rule No. 17, driveways
conform to Chapter 22 of the Hawaii County Code, drainage improvements meet
Department of Public Works approval, development related run-offbe disposed of

on-site, installation of a back-flow preventer be approved by the Department of Water
Supply and that a Solid Waste Management Plan be submitted to the Department of
Environmental Management for review and approval.
"there was no Statements from the Public on this matter. The applicant was present and
Councilmembers Pilago and Holschuh congratulated and commended the applicant for the
proposal, and the services and educational opportunities she will provide for the blind and
disabled.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 158 and
recommends its passage on first reading.
