No. 466/Bill No. 159 PLACE: Councilroom TIME: 10:00 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii Your Committee on Planning, to which was refen'ed Bill 159, which amends Chapter 25, Article K relating to the City of Hilo Zone Map, reports as follows: Bill No. 159, transmitted by Communication No. 466 from Mayor Harry Kim, dated September 20, 2005, presents an amendment to Chapter 25 (Zoning Code) of the Hawaii Code 1983 (2005 Edition) related to Plan Approval and Landscaping. I'he purposes of Bill No. 159 arc the following: I . '1'o delete the requirements of Plan Approval and Landscaping for the construction of one single-family dwelling and accessory buildings on a lot in the following zoning districts: Double-Family Residential (RD), Multiple-Family Residential (RM), Residential-Commercial Mixed Use (RCX), Resort-Hotel (V), Neighborhood Commercial (CN), General Commercial (CG), Village Commercial (CV), and Downtown Hilo Commercial District (CDH), and 2. To eliminate duplication of effort relating to requirements of Plan Approval and landscaping for construction ofone-single-family dwelling and accessory buildings and pertinent requirements for asingle-family dwelling and accessory structures at the Building Permit level. Communication No. 466 reports the Hawaii County Planning Commission, as required by Chapter 4, Sec. 6-43(C), Hawaii County Charter, considered the amendment to Chapter 25 (zoning Code) on September 2, 2005. The Planning Commission favorably recommended to amend Chapter 25 (Zoning Code) by deleting the Plan Approval and Landscaping requirements for the construction of one single-family dwelling and accessory buildings per lot within the various zoning districts noted in paragraph one (I) above. Communication No. 466 also transmitted the Planning Commission's September 2, 2005 Hearing "Transcript in which the Planning Department, through its Planning Director, submitted the lbllowing comments: I . Within the Planning Department there are two (2) steps of permitting that essentially duplicate each other. One is Plan Approval and the other is an application for a Building Permit. Plan Approval required under the current Zoning Code has similar PC REPORT NO. 39 Communication 466 Bill 159 Page 2 requirements to that of an application for Building Permit, except Plan Approval does not require structural details. It does require description of building, setbacks, parking and proposed landscaping which is reviewed by staff then signed off as a Plan Approval. At the time a Building Permit application is submitted, structural details are required, but then typically, a Building Permit Looks at many of the same things all over again. 2. It was decided that Plan Approval is not necessary for asingle-family residential zone. The issue of the use of the property is checked at the building permit stage and any other conditions of approval, say, a rezoning ordinance, will typically be done at the subdivision review stage or could also be done at the Building Permit stage. 3. "T'o eliminate unnecessary work for both the Planning Department and the applicant, this suggested amendment to the Zoning Code is recommended. At this Planning Committee Meeting on October 17, 2005. Bill No. 159 (Draft 2) was transmitted by the Office of the County Clerk, noting Draft 2 contains non-substantive tonnatting changes to correct errors in the ramseyering of Bill No. 159. ]t was noted that these changes were necessary to preserve language in the 'Coning Code that would otherwise be inadvertently deleted by Bill No. 159 (Draft 1). There were no Statements from the Public.
