SUBJECT: Proposed Bill No. 89, Draft 2 Waikoloa Ma a, LLC
Ntached for your favorable consideration is proposed Bill No. 89, Draft 2, with the following amendment
per discussion with Sidney Puke, Planning Consultant at the November 8 Planning Committee meeting.
Draft 2 omits the amendment to Condition 1 which was included in Communication No. 230.7, and
includes the following proposed amendment Ur Condition H of Bill No. 89:
"I1, Beiiire final subdivision approval, applicant must obtain reclassification of the RA-Ia
zoned area Irom the State band Use Commission to the Rural or Urban district Prior to
the submittal of plans fora >rf, ailing or any associated permit for a eolf course to the
County for review and approval, the applicant shall consult with the Waikoloa Villa>;c
Association and„ the County Council relative to the timink and propriety oP such a use.
This condition except for the consultation requirement for anv golf course, may be
waived by the Planning Director, after consultation with Corporation Counsel, if an
appcllatejudicial decisirnr, or substantive change to Chapter 205, Hawaii Revised
Statutes, clearly establishes the legality of this prgject in the Agricultural State Land Use
dish-icl, including the residential uses of the lots;'"
Dr.~fi 2 of Condition H clarifies that the applicant will come back to the Waikoloa Village
Association and the County Council "relative to the timing and propriety" of the golf course use.
