From HAWK of Knilua Kano -John Hartman Th~S memo is an official complaint to Mayor Harry Kim and HUD, DC>J, arld ABA that the ol,aye named project, which is federally funded through the County of Hawaii CDBG, is in wolotion of the HUD CDBG, Section 304. ABA, and ADA. The County of Hawnii and the Boys and Girls Ctub, nt'e not allowed to discriminate against persons with disabilities. The County through their policies under the fcderol CDA6 requirements should have refu4ed to allow the Pony Ball club to play nt the Boys aatd 6irl® <:iub boll field. The County is under major ADA lawsuits so you would think they would be chccF ing themselves out to make sure thty had developed and promoted the required federal rules ?hat protect the people of our county from diacriminat~on and kwrsuits. Private clubs like the pony Base Ball Ctub can promote Char own Welts under their awn raof iF they operate within their own private domain. However if the private club wanes to use the. public facilities they would be required to follow the State and County's rules and regulatinns. These rtgulotions ore True for any place in the USA be[0u9e the ADA and Section 504 an: federal rglionol regulations. It is illegal for the Potty Club to di5crimrrpte M public proper^y anywhere in iht US I also request that the County show me the documentation that was forwordad to the Boys: and Girls Club m laymen's terms that carefully explains and assists them with the requirements they nteded to have in place os o federally funded agtncy- In other words what County of Hawaii's programs, policies and procedures are used to dok out the money from federal ageneies7 How does the County help to protect those programs from viakrtions?
