RE: TESTIMONY ON RESOLUTION 178-05, CONDEMNATION OF ROAD B, TMK 7-3-5-101
Dear Council Members,
I am writing on behalf of myself, my husband William S. Waller, Danny Becker, and Noriko
Becker. The ownership as stated in the resolution is not entirely accurate and we request the
committee vote to defer this resolution until all ownership interests are resolved. Perhaps the title
searcher needs to look a little further.
My husband and I are the owners of TMK 7-3-005-093-0001 with an undivided 50% 2/80'"
interest in this roadway lot along with the owners of TMK 7-3-005-093-0002 or 1180'" interest
each, which was recorded with the Bureau of Conveyances on 2/25/93 on document number
93-032178 that was conveyed to us from Kim, Carol, Edwin and Marietta Maier. These
transactions show up in the County's Parcel History TT102 Report for TMKs 7-003-005-093-0001
and 0002 as transactions numbers 162890 and 162893 and are attached as exhibits 1 and 2. I
was unable to make contact with Assistant Corporation Counsel Gerald Takase by this writing tc
find out how this information was obtained and assist in correcting this mistake. I have not
attached this deed because of the number of pages it contains and will forward it to Mr. Takase
as soon as he returns my phone call to discuss this error.
Danny and Noriko Becker owners of TMK 7-3-5-110-001 have a 50% undivided 2/80'" or 1/80`"
interest in this roadway parcel which is part of their common element owned with the Kim Beltz,
etal. as shown in exhibit 3
20/80`" or 1/4`" of the ownership of this road parcel is spread among parcels 7-3-5-93-0001,
93-0002, 94, 103-0001, 103-0002, 104-0001, 104-0002, 105. 106, 107, 108, 109, 110-0001 and
110-0002as shown in exhibit 4. The parcel numbers followed by 0001 and 0002 are the 1 acre
parcels that were later CPR'd into 2 parcels. The individual parcel's interest in Road B follows the
parcels and would have been conveyed as such. I have not seen the deeds of my neighbors, but
I would not be surprised if their interests in Road B were overlooked like ours was originally and
therefore did not show upon the TT102 reports, but are in their deeds. I realize that it is not a
function of the Real Property Tax Office to guaranty the accuracy of the information they have in
their system and it is up to the individual parcel owner to provide proof of their interest in Road B.
We are still opposed to the opening of the Holu/Keokeo connector for safety reasons.
Please defer this resolution and give my neighbors time to come forward with their
documentation so their ownership interest may be verified.
