Dear Chairman Higa and Council Members:
RE: Communication 491
Request for Executive Meeting
At the meeting of the Hawaii County Council scheduled for November 22,
2005, the Council will consider the above communication generated by our office.
This communication explains the State of Hawaii Office of Information
Practices interpretation of "serial communications," and provides Council
members with advice on possible legal sanctions which may befall any
government officer who fails to comply with the State Sunshine Law.1
Our office asked this matter be scheduled for executive session, in the
event any Council member had any questions concerning his or her liability.
Under the Sunshine Law, such an attorney-client discussion may be had in
executive session. We wished to ensure your right to candid and legally
privileged discussion was properly preserved.
I did not know whether the Council or its individual members had any
specific questions, based on our written communication, subsequently numbered
491. For this reason, in an abundance of caution, I asked this matter be placed
in the Referrals for Executive Session portion of the agenda.
However, in the interest of pursuing and ensuring transparency in
government activity, if there is no need for an executive meeting, please let me
know, so we may conduct our discussion in open session.
