RE: Transmitting a draft 2 of Bill 148.
An ordinance amending chapter 25, (7,oning Code) of the Hawaii County Code related
to Agricultural Tourism.
Transmitted for your consideration is a draft 2 of Bill 148. This draft makes the following
changes to the bill:
1) Adds `okinas to the word Hawaii.
2) Inserted appropriate prefatory language in all sections in the bill to clarify the nature of
changes proposed to the zoning code.
3) Reinserted language contained in subscction 25-2-75(e) relating to action on a plan approval
application, which appears to have been inadvertently lefr out of the bill. Draft 1 of the bill
(on page 3) proposes that this section be renumbered to read 25-2-76. In including this
change, draft 1 inadvertently left out subscction (e) of section 25-2-75. Draft 2 of the bill
replaces this language.
The reinserted language reads as follows:
"(e) The director shall render a decision to either approve or deny a plan approval
application within thirty days afrer acceptance of the application. If the director fails to
render a decision within the thirty-day period, the application shall be considered
approved without further certification by the director." , L LL

4) In subsection 35-5-62(a), which is amended in section I 1 of draft 2 of the bill, permitted
uses "cemeteries and mausoleums" and "crop production" were not listed in the proper
order. Draft 2 of the bill corrects this.
5) Makes other changes to contbrtro the bill to the Council's drafting standards.
