Re: Draft Bill For An Ordinance Initiating a Hawaii County Charter Amendment
(1991 Edition as amended) Relating To The Police Commission
This acknowledges receipt of your letter dated September 3, 1997, requesting
comments on the draft bill for an ordinance initiating a charter amendment to the Hawaii
County Charter (1991 Edition) as amended, relating to the Police Commission.
We recommend the language of Section 7-2.2, "Statement of Hiring Policy," be
amended to be applicable to all departments and organizations within the County. This
would provide for a more uniform and consistent policy throughout the County and not
only to the Police or Fire Department, per se.
While we defer final comments to the Police Commission, we further recommend that
the proposed amendment of Section 7-2.4 "Political Activities Prohibited" be deleted, as
it may not meet the constitutional test of conforming with the first amendment's
provisions, nor the State Constitution.
