RESOLUTION NO. 222 ~5
RESOLUTION AUTHORIZING THF. PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF
RF,AL PROPERTY FOR THE OFFICF, OF THE COUNTY COUNCIL-CLERK.
WHEREAS, Section 10-1 1 of the County Charter requires that any contract, lease, or
other obligation requiring pad ment of funds from the appropriations of a later tscal year and
more than one fiscal year be approved by resolution; and
WHF,REAS, the Ha~ai`i County Council finds that uncertainty of the construction
period, and the unknown schedule for phasing each of the eight wings during the capital project
coupled with the perceived risk of asbestos removal warrant a planned move of its employees to
a publicly convenient, environmentally safe and comfortable work place; and
WHEREAS, the Ofliee of the County Clerk-Election Division finds that it must move
out of the County Building due to the massive capital improvements being proposed by the
Department of Public Works related to rc-roofing improvements and asbestos removal for a
period of at least twelve months, which would occur during an election year; and
WHEREAS, the Office ofthc County Clerk-Election Division recognizes that the
construction may severely impede its operations and needs an uninterrupted 2006 election year
to properly service the candidates and the voters of Hawaii: and
WHEREAS, the temporary move of the Election Division to Prince Kuhio }'lazy could
increase voter registration and absentee voter turnout due to its high visibility, convenient public
location and a high volume of toot traffic; and
WHEREAS, there arc sufticient funds budgeted in the current fiscal year to cover the
anticipated obligations of the County under the lease agreement: and
WHEREAS. the Hawaii County Council wishes to enter into a one (1) year lease with
HO Retail Properties I, L.P. for the 5,000 square feet of office space located at the l 11 East
Puainako Street, Hilo, I{awai i, 9672Q at an approximate cost of $8,594.00 per month, including
taxes.

I . That the Mayor is hereby authorized to enter into amulti-year lease agreement for
office space foi. the Hawaii County Council.
2. That sufficient funds be budgeted in future fiscal years to cover the anticipated
obligations of the County under the lease agreement.
BE IT FINALLY I~F:SOLVED that a copy of this resolution be transmitted to the
Department of Finance and ti°~. Office of the County Clerk.
