W W 207 DOCKET NO. OS - V W W - 41 Pursuant to H.R.S. §342D-7(i), Hawaii Revised Statutes, the State Department of Health (DOH) seeks written comments from interested persons regarding the following. Jeff and Kaui Trainer of 433 Kaumana Drive, Hilo, Hawaii have applied for a five (5} year variance from Hawaii Administrative Rules (HAR) from Section 11-62-31. I (D) which states "The total wastewater flow into one individual wastewater system shall not exceed one thousand gallons, and one individual wastewater system shall not serve more than five bedrooms, whether they are in one dwelling unit or two." Mr. Ronald Nickel, Civil Engineer, is the individual authorized to act for the applicant. The applicant states the building was constructed in 1981 with five (5) bedroom. The dwelling was split into two (2) separate units in 1995. The split was approved by the DOH. The parcel is 10,712 square feet. The owner is now being required by EPA to convert the existing large capacity cesspool (LCC) into a septic system. The current wastewater flow is 500 gpd. The applicant has made the following comments. 1. There are more bedrooms than allowed under the current regulations. 2. It would be difficult for the owner to change one ofthe bedrooms to anotheruse, they would still be requested to install a septic tank. 3. The applicant believes this variance request is in the public interest because the LCC will be upgraded to an IWS (septic system). The IWS plans will be designed by an engineer and will be submitted to DOH for review and approval. The new IWS will provide a better wastewater treatment system compared to the existing LCC. Therefore minimizes impact to the environment. 4. The existing LCC will be upgraded to an IWS (septic system). The IWS will provide a better treatment system prior to efl7uent disposal. The IWS will be designed and constructed to meet the Department of Health standards. The impact to the environment will be minimized compared to the current wastewater disposal. 5. In order to meet the requirement, one bedroom would have to be used for another purpose. 6. The variance is requested for the maximum of five (5) years. Attachments including a letter from the Wastewater Branch dated September 15, 2005, plot plan map, building permit application, building permit and billing summary have been included with this application for variance but can not be shown here. The information previously provided to you by email is for the most part accurate. The cesspool serving the current building located at the above address is considered a large ~ capacity cesspool. Under EPA rules for residential situations, a large capacity cesspool is an cesspool that serves multiple dwellings. Neither the number of persons served or wastewater flow is a criteria in determining if a residential cesspool is large capacity. As your dwelling was converted into a ~ main dwelling and ohana dwelling, the cesspool is serving multiple dwellings even if the dwellings are under the same roof. At this time we believe that you have a number of options regarding your large capacity cesspool. They include the following: A. Upgrading your cesspool: As your property is 10,712 square feet in area, only a single Individual Wastewater , System (IWS) is allowed. Therefore, as part of upgrading your cesspool, you will be required to obtain a wastewater variance from the Department. The variance is to use a septic tank for flows larger than 1000 gallons per day (6 bedrooms X 200 gallons/day = i 12000 gallons/day). Variance forms are available from the Department and are also on X our web site. Please download the Simplified Large Capacity Cesspool Variance Application form. As part of the cesspool upgrade, you will be required to have an engineer design your new wastewater system, a contractor install it and the engineer inspect the completed new wastewater system. The engineer will then submit his/her final inspection report to the Department such that we can authorize use of the new system and close our files. Based on the information you have provided, the Department will allow you to utilize your existing cesspool as a seepage pit for effluent disposal from a septic tank. In lieu of a variance, you can eliminate one or more of your bedrooms. This will involve obtaining a building permit from the County. Even if one or more bedrooms is eliminated, you will still need to hire an engineer to design a new wastewater systems for you, a contractor to install the system and a final inspection report submitted to the Department. These functions rest solely with the Department. B. Eliminating a dwelling unit: You may wish to consider eliminating one of the dwelling units. This will involve changing the use of one of the dwellings. For example, you could eliminate the kitchen from the ohana unit and convert the building back into a single family dwelling. This will I involve changing the use of an existing structure and we advise you to obtain a building permit from the County for this activity. Please be informed that under EPA's definition of a dwelling, as long as the building contains areas for food preparation, eating, sleeping and toilets, it is considered a dwelling. This definition is very liberal and is not dependent on County designations or definitions. Thus even if you eliminate the kitchen from the ohana unit, if the uhit is utilized as a residence independent ; of the primary residence, EPA could still consider the situation multiple dwellings being served i by a single large capacity cesspool.
