Higa, Chair and Hawaii County Council Members 25 Aupuni Street Hilo, Hawaii 96720 RE: Transmittal for Drafr 3 of Bill l62 I am submitting for your consideration Drafr 3 of Bill 162. I have reviewed Council member Pilagds transmittal letter and his amendment to Bill 162. I disagree with the amended language of Condition H in his Draft 2 of Bill 162. I feel that the requirements stated therein are excessive given the circumstances. Furthermore, I do not appreciate the misuse of my name in the transmittal letter. Mr. Pilago implies that I requested the excessive requirements of his Draft 2 amendment to be imposed upon the applicants. You will recall that during our discussion in the November 22, 2005 council meeting, I stated that Condition H needed additional language. However, at no time did 1 suggest, imply, or otherwise propose this unwarranted condition. My comment at the council meeting was to treat all applicants fairly. Therefore, the language I am proposing for Condition H, via Draft 3 of Bill 162, is lair to all applicants and is a standard requirement for subdivision approval My proposed amendment to Bill 162 is as follows: H. Prior to submittal of a subdivision application for the subject propertv, the applicant shall upon consultation with surroundine propertv owners and other concerned public agencies_,_prepare and submit a drainage plan relating to the proposed subdivision for review and approval of the Department of Public Works The approved drainage plan shall reflect all development venerated runoff to be retained or disposed of on-site and shall not alter anv existing water courses that may be entering or exiting the subject propertv or be directed toward anv adjacent properties. C:oSe Higa, et aI Page 2 December ] , 2005 It is also my understanding that the Inaba family made good faith efforts to set up a public meeting to discuss the drainage concerns, as requested by Council member Pete Hoffmann, but due to scheduling problems within the Waimea community, a meeting has not been held.
