No. 203-05 PLACE: Council Chambers TIME: 12:45 p.m. Council Chair and Members' Hawai`i County Council Hilo, iiawai`i 96720 Your Committee on Finance, to which was referred Resolution No. 203-05, reports as follows: Resolution No. 203-05, transmitted by Director of Finance William Takaba, via Communication No. 530, dated October 31, 2005, rescinds Resolution 249-96 authorizing the acceptance of the donation of real properties from Daniel Isami Funakoshi, Tax Map Keys: (3)1-2-034:078 and 1-2--034:094, and authorizing the Mayor to convey said real properties back to Daniel Isami Funakoshi. On February 7, 1996, the Council passed Resolution 249-96, which.authorized acceptance of the donation of the properties listed above. Mr. Funakoshi believed at that time that the subject parcels were inundated with lava and were of no foreseeable use, and quitclaim deeds were prepared and filed with the Bureau of Conveyances. In preparation for the auction of the two parcels, it was discovered that they were not inundated with lava, and when Mr. Funakoshi was notified, he expressed a desire to have the parcels returned to him and agreed to pay the back taxes. During its discussion, Your Committee recommended that the Finance Department look into waiving the real property back tax fees due to the fact that when Mr. Funakoshi made the donation, he thought his land was inundated by lava. Some members of Your Committee were concerned that since Mr. Funakoshi is getting a windfall with his property back, that it may be fair that Mr. Funakoshi pay the back taxes.
