Re: Capital Budget
Enclosed is a bill for an ordinance adding the Prosecutor's Office at Aupuni Center project for
$1,700,000 into this fiscal year's Capital Budget. This project, initially appropriated at $3,450,000, is
in need of this supplemental appropriation as the apparent low bid exceeds the current available
appropriation. This request for the additional $1,700,000 is necessary to cover the current
construction cost plus a recommended contingency fund for this project.
In order to proceed with the start of construction in a timely manner and to avoid possible
construction cost escalation due to delay, the Department of Public Works respectfully requests a
waiver from the Finance Committee and to have this bill heard at the Council meeting scheduled
for December 21, 2005.

A. REQUEST:
Amend Ordinance 05-87, the Capital Budget by adding an appropriation for:
Prosecuting Attorney's Office at Aupuni Center $ 1,700,000.00
Waiver Finance Committee
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The competitive low bid result of $4,013,602 exceeded the current available appropriation.
Prosecution of the construction will require a contingency fund to proceed with potential additional cost
change orders without delay. A 20% contingency on the bid results or $802,720 is recommended for
this type of construction renovation. The current construction cost plus recommended contingency
fund for the project is $4,816,322. The current available appropriation is $3,117,794. This request is
for the additional $1,700,000 required to successfully complete the project construction.
In order to proceed with the start of construction in timely manner and avoid possible construction
cost escalation due to delay, we request to waiver finance committee review.

RE: Bill No. 189 An Ordinance amending Ordinance no. OS-87, as amended,
relating to public improvements and financing thereof for the fiscal year July 1, 2005 to
June 30, 2006.
Pursuant to Section 2(g) of Kule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, l understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
