In this letter, Mr. Young is requesting written confirmation by December 30, 2005, on whether or not the County of Hawaii is genuinely interested in the management of the small boat harbor facilities on the island of Hawaii. Also attached is my response to Mr. Young's letter. As we have not received information that is necessary to analyze ~+~hat a commitment to this takeover truly means for the County government, 1 do not feel it is prudent to make any commitment at this time. Our first step in this process was to offer each county the management of the small boating facilities in its respective county. The Hawaii County Council has expressed interest in further investigating the possibility of management, and we have forwarded additional information to your Managing Director for review. In order to move forward with decision making soon so that we can begin the transfer process early next year, we request written confirmation by December 30, 2005, whether or not your County is genuinely interested in the management of these facilities. Additionally, we ask that you submit a detailed timeline of your timeframe for the transfer, as well as, the contact information for the team you have put together to work on this process. If you are interested we need a commitment from you to work with the State to expedite the processes. We would like to make clear that the Department has made this transfer a priority and is committed to work to make it a reality. We realize there are legal questions that still need to be answered. The State is currently working with the Attorney General to develop the legal process for such a transfer, and we would like your Corporation Counsel to work closely with the State's legal staff in all discussions as well. As we have stated in the past, if ultimately the counties are not interested in taking over management, we will be seeking management alternatives from private interests/operators. At this time we are pursuing a possible Request for Proposals process for those counties that choose not to pursue the transfer. Box 621 Honolulu, Hawaii 96809 Re: Small Boating Facilities Dear Peter: I have received your letter dated December 1, 2005, requesting a decision by December 31, 2005, on whether the County of Hawaii is interested in the management of the small boating facilities on our island. Thank you for your recent discussions with Managing Director Dixie Kaetsu on this subject, and for the fiscal information from your web site on each facility to be transferred. As Ms. Kaetsu told you, we need additional information before the County can make an educated analysis and decision about whether taking on this additional responsibility is in the best interest of the boating community and the general public. Information that has been requested includes: • Amount of liability for debt service on bonds used for past improvements that the County of Hawaii will be required to assume; • Existing agreements with concessionaires and licensees at various facilities that must be assumed, and what authority the County will have to enter into additional agreements; • A schedule of deferred maintenance for each facility showing the repairs needed and the estimated cost of these repairs; • Current level of DLNR staffing to operate these facilities, and your estimate of the optimum staffing level necessary to run this program; • Status of compliance with the Americans with Disabilities Act requirements for each facility; • Status of compliance with EPA mandate on the elimination of large capacity cesspools for each comfort station. fhe County of Hawaii administration cannot make a commitment or establish a timeframe for any transfer until we have the necessary information to clearly understand what this commitment will I law~ri~ i County is an equal opportunity provider and employer.
