RE: A Bill for an Ordinance amending Article 3, Section 3-4
of the Hawaii County Charter relating to vacancies on the Council
Presently, Article 3, Section 3-4, of the Hawaii County Charter regarding Council vacancies
states:
"If the vacancy occurs more than two years before the end of the term, and sixty days or
more before the next regularly scheduled primary election, the council shall, through its
clerk, immediately issue a proclamation announcing that candidates shall be nominated to
fill the unexpired term of the office at a special primary election to be held...."
Because members of the Council only serve for two years, most of this section of the Charter
relating to a special election is moot. The attached bill deletes this and other inconsistent and
conflicting sections of this article. This bill, which is referred to the Finance Committee, is
proposed as a housekeeping measure.
