' To: counciltestimony@co.hawaii.hi.us Subject: Bill 162, Yoshio Inaba request for rezoning and subdivision Council Members, 'hank you very much for the opportunity you gave us last evening (December 19) to give our testimony about Bill 162. ~ attended that meeting and regret that I will not be available tomorrow for the 10:15 AM second reading and final vote on the Bill. There were several things that stood out for me at the Public Hearing and I'd like to summit my comments as public testimony for tomorrow's Council meeting regarding Bill 162. Mr. Elarinot3~, who once represented us, spoke about his time as a police officer when Kamuela Highlands was being subdivided and built, and said that everyone thought it was ajoke, because of the existing flooding in the area. 'fhc Cou7t}' Council at that time, obviously made a mistake in letting our subdivision go through, without ~iddressing the hydrology oi~ the area. f strongly believe, that this is a perfect opportunity and your responsibility to du the right thing. and not repeat the mistakes of the past. Yes we have flooding, yes it should have been addressed years ngo, however it wasn't, and now we all arc paying the price. We arc supposed to learn from our mistakes and not make the same one again. believe that the Inaba's and every subdivision rezoning request from this day forward should be carefully looked at, taking into consideration all problems, concerns and repercussions that may arise due to changing the landscape. We have the technology and lessons of the past to guide us. Adding Condition 13 to the Bill was a step in the right direction, however, the last sentence states, "Furthermore. the approved drainage plan shall be implemented prior to or in conjunction with the issuance of lnal subdivision approval." I believe the words "or in conjunction with" should be removed from the Kill making it clear that once the drainage plan has been approved it should be implemented prior 4i final subdivision approval.
