Dear Chairperson Higa and Counci] Members:
Last month, I sent you a copy of a December 7, 2005, letter to Peter Young, Chairperson of
the Department of Land and Natural Resources. This letter requested additional information
related to the proposed transfer of responsibility for small boat harbors and ramps to the
County of Hawai` i. Attached for your information is a copy of the response from Mr. Young.
]'lease share this with the ad hoc fact-finding committee that is to be appointed by the Council
to investigate the feasibility of this proposed transfer.
1 have asked Finance Director William Takaba to have his staff begin looking into the
financial consequences to the County if this additional responsibility is taken on. Please let
the ad hoc committee know that the Finance Department is a resource, and we look forward to
working with you to determine what will be best for the boating community and the residents
of the County in general.

"Thank you for your recent response to my December 7, 2005, letter. Your answers to
questions raised are appreciated, but additional information is needed in several areas. I am
referring this issue to William Takaba, the Director of Finance, with a request that he have his
staff look seriously at the fiscal consequences of the acceptance by the County of
responsibility for small boat harbors and ramps. You will be contacted for further information
as the Finance Department does its review.
In addition, the County Council has passed a resolution to establish an ad hoc fact-finding
committee to,look into this issue. I will share your response with the Council I am sure the
ad hoc committee will want further information when it begins its work.

Dear Mayor Kim:
Thank you for your letter of December 7, 2005. We are eager to continue to work with you on
the potential transfer of the Department of Land and Natural Resources' (DLNR) small boat
harbors and ramps (SBH) to the County of Hawaii (County).
The following are the responses to the questions raised in your letter:
• Amount of liability for debt service on bonds used for past improvements that the County
will be required to assume.
The State envisions retaining the debt service of these bonds under an agreement. The
County would be required to pay the State of Hawaii a percentage of the debt proportionate
to their County.
• Existing agreements with concessionaires and licensees at various facilities that must be
assumed, and what authority the County will have to enter into additional agreements.
All leases and revocable permits would need to he honored by the County. Once these
commitments expire, it will be left to the County's discretion to renew and/or enter into

additional agreements. Below are the current revocable permits and leases that the State has
at its SBH on the Big Island:

Marina Seafood
University of Hawaii Institute of Marine Biology
Honokokau SBH Current Leases
Kona Fuel and Marine, Inc.

Kawaihae SBH -Revocable Permits
Island of Hawaii YMCA
Big Island Petroleum Inc.
Keauhou SBH, Reeds Bay, Wailoa SBH, Pohoiki Ramp, Puako Ramp and Kailua-
Kona Wharf -There are no leases or revocable Hermits at these SBH
Control and management of ocean recreation and commercial activity in State waters,
including commercial permits, would be retained by the DLNR.
Additionally, the cruise ship industry uses the Kailua-Kona Wharf, although there is no lease
or revocable permit for this activity. Enclosed is the Tentative Cruise Ship Schedule for
2006 and 2007.
• A schedule of deferred maintenance for each facility showing the repairs needed and the
estimated cost of these repairs.
A schedule entitled "DOBOR Island of Hawaii Proposed Capital Improvement Projects" is
included with this letter.
• Current level of DLNR staffing to operate these facilities, and your estimate of the optimum
staffing level necessary to run this program.
The DLNR currently has seven employees on the Big Island:

Additionally our Honolulu office serves as the base 1'or harbor operations across the State.
Positions within this office that are directly related to operations on the Big Island include:
Administration (1 Administrator, 1 Secretary)
Program Services (1 Boating Staff Officer, 1 Secretary)
Boating Safety (1 Specialist)
Engineering (2 Engineers, 1 Secretary)
Property Management (1 Property Manager)
Data Processing (I Data Processor)
Fiscal (2 Accountants, 2 Account Clerks, 1 Auditor)
The number of positions that the County will require to run the SBH on the Big Island would
depend on the operations of your County and the services that you already provide.
• Status of compliance with the Americans with Disabilities Act (ADA) requirements for each
SBH.
All of the State's SBH listed in the DLNR's ADA Transition Plan have either been
completed or are under construction to comply with ADA standards. The following is a list
of these facilities:

accessible.
• Status of compliance with EPA mandate on the elimination of large capacity cesspools for
each comfort station.
There are no "non-compliant" cesspools at State SBH on the Big Island.
In April 2004 the Kawaihae SBH wastewater disposal system's required maintenance was
estimated at approximately $254,000.
Please keep in mind that this offer for management transfer is with all of the obligations and
opportunities associated with the SBH. Projects that are planned or underway will be fumed
over "as is" from the State to the County at the time of transfer.

As an update to our last letter, we have met with the Attorney General's Office to discuss the
transfer process further. We have also written letters to the State Directors of the Deparhnent of
Budget and Finance and Deparhnent of Human Resources Development to obtain further
information on fiscal and personnel issues. We will keep you updated on their responses.
Additionally, we are investigating the jurisdiction of five SBH on the Big Island that were not
included in the packet we provided you earlier. Kaulana Ramp, Milolii Landing, Napoopoo
Landing, Kauhako Landing and Honuapo Pier. We will forward you additional information as
soon as it is available.
We understand that the Cowrty Council introduced a resolution in early January pertaining to the
transfer of SBH to the County. The DLNR looks forward to working with the County Council as
well as yourself in continuing this process.

(1) This list was generated from incorporating infomation from 2 previous
reports prepared by the previoius Boating Administration.
(2) The projects on the list were verified with Big Island staff to
determine if these projects are items that still need to be implemented at
their facilities.
(3) Projects identified on the 2 previous reports that have already
received recent funding were eliminated.
(4) A 2%/year inflation rate was used to escalate the cost to current
prices.
(5) These cost identified are "construction only" costs and do not include
design cost. Design cost are estimtaed to range from 15%-20% of the
construction cost depending on how complex the design is (how many
sub consultants are needed), how many permits and/or environmental
documents are needed, and how much public involvement is required.
(6)These costs are subject to change due to 1)The bidding climate when
each project is bid out or 2)The condition of the repair at the time the
project is advertised (existing condition may have worsened).
(7)The list not only provides the items that need to be "repaired" at the
facilites, but includes items and cost associated with "new" proposed
projects. These new proposed projects are needed to provide the
necessary safety for boaters (i.e. new lighting at parking/washdown
areas, paved roadways etc.) and also are proposed projects needed to
meet the demands of the increased amount of boaters (i.e. new parking,
new comfort station, new piers, etc).
