Your Committee on Public Works and Intergovernmental Relations, to which was referred
Resolution No. 230-05, reports as follows:
Resolution No. 230-05, transmitted by Assistant Corporation Counsel Gerald Takase via
Communication No. 602, dated December 14, 2005, authorizes acquisition of private properties by
eminent domain, being those portions of Tax Map Keys: (3)1-3-003:005 and 006, located in Puna,
County and State of Hawai`i, adjacent to the Kalapana Road, Highway 137.
The purpose of the acquisition is for realignment of the Kalapana Road because of erosion into the
sea.
Section 101-13 of the Hawai`i Revised Statutes requires that a condemnation action by the County
of Hawai`i must be authorized by a resolution of the County Council.
According to Assistant Corporation Counsel Takase, the owner of the subject properties
(Kamehameha Schools/Bernice Pauahi Bishop Estate) is not opposed,to the acquisition.
There was no testimony from members of the public regarding the proposed acquisition.

Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose
and intent of Resolution No. 230-05 and recommends its adoption.
