Thank you for your letter dated September 10, 1997, containing an annual progress report
of the proposed development as required by Condition J of Change of Zone Ordinance
No. 92-92.
According to your annual progress report, "no lots have yet been sold and lots are not yet
being used for agricultural purposes. An extension of the deadline for Condition F will be
requested if and when required." Condition F states:
"F. It shall be demonst*•lted to the satisfaction of the Planning Department that
agricultural activity is being conducted on the subdivided lots within three years
from the date of final subdivision approval. For the purpose of this condition,
"agriculture" shall be defined as the cultivation of crops, including but not
limited to flowers, vegetables, foliage, fruits, ,forage and timber; game
propagation; raising of livestock including but not limited to poultry, bees, fish
or other animal or aquatic life that are propagated for economic or personal use.
This condition shall be incorporated in each of the deeds for the proposed lots
and duly recorded with the State Bureau of Conveyances. A copy of the
recorded deeds shall be filed with the Planning Department within one year
from the date of final subdivision approval of the lots." ~„one >>ao

Final subdivision approval (Sub No. 6619) was granted on August 10, 1995. As such,
agricultural activity must be conducted on the subdivided lots within three years from the date
of final subdivision approval, on or before August 10, 1998. In addition, a copy of the
recorded deeds should have been filed with this depaztment by August 10, 1996. We have not
received a copy of the recorded deeds, therefore, please forward them to our office as soon as
possible.
An initial extension of time was granted on November 28, 1994, to complete the construction
of the subdivision. As such, should you request an additional extension of time, your request
must be forwarded to the Planning Commission through this office. A $250 filing fee,
original and twenty copies of the request shall be submitted when requesting an additional
extension of time. A public hearing to consider your request will be held within 120 days.
After such a hearing is conducted, the request and the Commission's recommendation will be
forwazded to the County Council.
We will transmit your report to the Planning Commission and the County Council for
their information. As. a reminder, your next annual progress report will be due on or before
August 18, 1998.

Dear Planning Director:
The development status of the above referenced property, organized according to
conditions as specified in above referenced County Ordinance, is as follows:
(A) The applicant understands his responsibility to comply with all the stated conditions of
approval and will ensure that any successors or assigns are aware of the same.
{B) Final subdivision approval was granted on August ? 0, 1995.
(C) Access to development has been completed and has been approved by the Department
of Public Works.
(D) The drainage improvements for the development have been completed and have been
approved by the Department of Public Works.
(E) The method of sewage disposal shall be designed to meet with the approval of the
Department of Health.

(F) Due to the depressed real estate market in the area, no lots have yet been sold and lots
are not yet being used for agricultural purposes. An extension of the deadline for Condition
F will be requested if and when required.
(C) No unidentified sites or remains such as artifacts, shell, bone, or charcoal deposits,
human burials, rock or coral alignments, pavings or walks were encountered during the
course of development of the subdivision.
(H) The applicant intends to comply with all other applicable laws, rules, regulations and
requirements.
(I) Should the Council adopt a Unified Impact Fees Ordinance the applicant shall respond in
accordance with Condition I.
(J) This letter serves as the fifth annual progress report required by Condition J. Subsequent
annual reports will be submitted until the Planning Director acknowledges that further reports
are not required.
(K) An extension of time is presently not required. Should an extension of time become
necessary, the guidelines of Condition K will be recognized.
