N,k 0. • - 7~ 4~ ~y y~ilry~ COUNTY OF HAWAII STATE OF HAWAII ' ~'r%ae'a~"' RESOLUTION NO. 253 fT6 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF TRANSPORTATION, PURSUANT TO HRS 46-7, FOR A DEPUTY PROSECUTOR TRAINING PROJECT WHEREAS, the State of Hawaii Department of Transportation's Safe Community Traffic Safety Program has authorized a Highway Safety Project grant to the Hawaii Office of the Prosecuting Attorney to provide training for its deputy prosecuting attorneys and other law enforcement agencies; and WHEREAS, this grant, derived from federal funds, will be used to provide statewide training and meetings for deputy prosecuting attorneys and police to improve communications between agencies and to improve the law enforcement system in its efforts to enforce traffic offenses; and WHEREAS, the overall goals of the interagency communication and training project are to make our roads safer and to improve the performance of the law enforcement system in its efforts to enforce DUI and other traffic laws by training deputy prosecutors, police, and medical responders in the conceptual, technical, scientific and trial aspects of DUI and other traffic offenses; and WHEREAS, the objectives of this project is to have a deputy prosecutor from each side of the Big Island of Hawaii to attend periodic traffic commanders meetings, to hold an annual training on DUI/negligent homicide, and to create guidelines for prosecution and investigation for DUI/negligent homicides and other traffic cases; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVE® BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, an agreement with the State of Hawaii Department of Transportation, to enable the County to implement a deputy prosecutor training project on as described in the application submitted to the Department of Transportation, attached hereto and incorporated herein by reference as Exhibit "A". BE IT FURTHER RESOLVE® that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVE® that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Office of the Prosecuting Attorney, and the Finance Department. In recent years there have been many changes to the DUI and traffic laws in the State of Hawaii. These frequent changes, which make trying these cases more difficult for police and prosecutors, require enhanced inter-agency communication for successful prosecution. With the increase in drug use, including methamphetamine (ICE), it is more common to find poly- substance use in traffic offenders. Currently traffic commanders from the police departments in the state meet quarterly to discuss traffic trends, however, prosecutors rarely attend these meetings. With the exception of the State Traffic Commanders meeting, there are no forums for deputy prosecutors, police and medical responders to communicate within the County of Hawaii nor throughout the state. SOLUTION Briefly describe the solution to the problem including community effons (List tasks that will be accomplished with the funding of this project). The solution is to improve communication, stay updated on laws and trends in traffic enforcement by providing funds for prosecutors to attend the state traffic commanders meetings and conducting annual interagency training among prosecutors, police, and medical responders. These forums will provide information on the proper interpretation of Hawaii's DUI and traffic laws and contemporary trial techniques, as well as the latest trends in traffic enforcement. The bringing together of deputy prosecutors, police officers and medical responders will increased cooperative efforts between these agencies and serve to standardize strategies among local agencies for a more uniform and consistent approach to DUI law enforcement throughout the state. State Goals and Objectives of Project. The overall goals of the interagency communication and training project are make our roads safer and to improve the performance of the law enforcement system in its efforts to enforce DUI and other traffic laws by training deputy prosecutors, police and medical responders in the conceptual, technical, scientific and trial aspects of DUI and other traffic offenses. Objectives of this project will be to have a deputy prosecutor from each side of the Big Island of Hawaii attend periodic traffic commanders meetings, hold an annual training on DUI/negligent homicide for police, prosecutors and medical responders, and to create guidelines for prosecution and investigation for DUI /negligent homicides and other traffic cases. EXHIBIT "A" State previous funding of the project and by whom. In 2004, the Department of Transportation provided funding for training in this area which was very successful. Currently, each Prosecutor's office is responsible for training its deputy prosecutors. While State and Federal Governments have funded traffic safety programs in the past; the previously allocated funds have generally been dedicated to local police departments and endeavors designed to prevent the occurrence of intoxicated driving. EVALUATION Describe the plan to evaluate effectiveness of project. Participants of the DUI/negligent homicide training will fill out a survey designed to measure the benefits of these communication and training forums. These surveys will measure the amount of information or knowledge gained as a result of their participation, the usefulness of the material covered, and the likelihood of such being applicable to cases they typically encounter. What is cost-ratio benefit of project? The project will produce a wealth of benefits that cannot be described in economic terms. At a relatively miniscule cost, the training deputies, police, and medical responders receive will enable them to properly support the efforts of the law enforcement system to keep DUI offenders off Hawaii's roadways. The interagency training will serve to bridge the gap between the justice system's ability to catch DUI and other traffic offenders and their ability to penalize them. This will not only improve the efficiency with which traffic safety funds are used, but also serve to treat and deter repeat offenders and deter habitual DUI offenders from driving. In short, this will save lives. Normally, the cost of sending an attorney to the mainland in order to attend a training costs the government well over $2,000.00. By creating an in state training program, we will be able to train 35 participants at a cost of $15,000, such would otherwise cost the government well over $70,000.00. What is potential of project becoming self-sustaining'? The project is self-sustaining in nature because the knowledge gained and shared by trained deputies will not depreciate, will not be consumed to exhaustion, and will serve its proper end throughout the longitude of these deputies' careers.
