Your Committee on Planning, to which was referred Communication No. 617 and attached Bill
200, transmitted by Mayor Harry Kim, dated December 14, 2005, regarding changing of the
district classification by Kulana Kea, LLC at Wainaku, South Hilo, Hawaii, TMK: 2-6-32: 4
and 5, (26.122 acres), reports as follows:
Bill No. 200 seeks to amend Section 25-8-34 (Papaikou-Onomea Zone Map) Article 8, Chapter
25 (Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the District
Classification of approximately 26.122 acres of land from Agricultural 20-acre (A-20a) and
Single Family Residential-15,000 square feet (RS-15) to Family Agricuhural 5-acre (FA-Sa).
Communication No. 617 reports that the Hawaii County Planning Commission, as required by
Chapter 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on December 2,
2005. At this meeting, the Commission concurred with the Planning Director's favorable
consideration of the change of zone. Communication No. 617, in synopsis, describes the
Planning Director's findings and recommendations as follows:
I. The applicants are requesting a Change of Zone from an Agricultural 20-acre (A-
20a) and Single-Family Residential-15,000 square feet (RS-15) to Family Agricultural 5-
acre (FA-Sa) for two parcels consisting of approximately 26.122 acres of land.
• "Che subject properties are located on the north side of Kulana Kea Road, approximately
8501eet west of the Kulana Kea Road-Wainaku Street intersection, at Wainaku, South
Hilo, I Iawai'i .
• Applicant Kulana Kea, LLC is the owner of the properties and intends to subdivide the
26.122-acre parcel of land into five (5) lots consisting of 5+ acres each. Applicant
intends to retain two (2) lots for its personal use and sell the remaining three (3) lots to
persons interested in trucking and/or backyard farming.
• The cost of the prc~jec[ is estimated to be approximately $300,000 for an off-site water
transmission line, water service laterals and driveway access to individual lots.
• "fhe subject properties currently have asplit-zoning and State Land Use designation as
the result of a prior subdivision approval consolidating and resubdividing a 14.69-acre
area that included the 1.372 acre portion of the subject project site. The proposed request
would remove the split-zoning from the properties.

• Access to the properties is from Kulana Kea Road, which is a private road with a 60-foot
wide right-of--way with 20-foot pavement from Wainaku Street to the Kulana Kea Street
- Kauhiula Road intersection.
• Water can be made available to the properties. The Applicant will be required to extend
the existing 8-inch water main along Kulana Kea Drive approximately 2,900 feet from
the water tank located on TMK: 2-6-32:25 to the intersection of Kaiwiki Road and
Kulana Kea Drive and to install service laterals to accommodate an appropriately sized
meter to each lot.
• All utilities and services are available to the project site.
2. The Change of 7,one request from Agricultural 20-acre (A-20a) and Single-Family
Residential-15,00 square feet (RS-I S) to Family Agricutural 5-acre (FA-Sa) will
conform to the goals, policies and standards of the General Plan Land Use elements.
3. The Land Use Pattern Allocation Guide (LUPAG) Map designates this area as Low
Density Urban.
4. The Land Study Bureau's Detailed Land Classification System identifies soils on the
properties as "C" or "Fair" for agricultural productivity.
5. The Change of Zone request is not contrary to Chapter 205A, Hawaii Revised Statutes
relating to Coastal Zone Management as the subject properties are located approximately
1,000 feet from the nearest shoreline and will not be impacted by coastal hazard and
beach erosion.
6. As the properties have been cleared and used for sugar cane and corn, it is unlikely that
there are any valued cultural, historical or natural resources to be found in the rezoning
area and there is no evidence that flora in the area are particularly used for cultural
practices.
7. A condition is included that provides for restrictive covenants in the deeds of all proposed
lots shall give notice that the terms of the zoning ordinance prohibit the construction of a
second dwelling unit and condominium property regimes (CPR) on each lot.
8. According to the Flood Insurance Rate Map (FIRM) prepared by the Federal Emergency
Management Agency (FEMA), the project area is within Zone "X", an area
determined to be outside the 500-year flood plain.
9. Requisite of the Planning Director's favorable recommendation for the Change of Zone
request, are fifteen conditions contained in Bill No. 200 that outline specific requirements
for the proposed project. Condition H provides that a restrictive covenant be included in
the deed to the mauka-most lot requiring the landowner to consult with the owners of
TMKs: 2-6-32:13, 14 & 20, regarding placement of structures, before submitting plans
for a building permit Condition I requires applicant to establish drainage easements and
maintain drainageways so as to direct water in a northerly direction away from Kulana
Kea Road.
At the January 19, 2006 Council Member Jacobson stated he was glad to see that there is
water supplied to these lots.
Council Member Holschuh confirmed no fair share assessment is required because of the
size of the lots and that the change from Single Family RS-15 to a Family Agricultural 5-
acre is a downzone.
At today's meeting, no testimony from the public was received and no discussion occurred.
Your Committee on Planning concurs with the Planning Commission and the Planning Director's
favorable recommendation for approval of the Change of 7.one request.
Your Committee on Planning is in accord with the intent and purpose of Bill 200 and recommend
it pass first reading.
