Comm. 658: APPOINTMENT OF NEWTON INOUYE TO THE COUNTY OF HAWAII
ENVIRONMENTAL MANAGEMENT COMMISSION _
From Mayor Harry Kim, dated January 23, 2006, submitting the nomination of
Newton Inouye of Council District 2 to the Hawaii County Environmental
Management Commission. A 49-year resident of Hawaii, Mr. Inouye is currently
employed with the Department of Health as a registered sanitarian. Not affiliated with
any political party, if confirmed, he will serve a term to expire on December 31, 2010.

REFERRALS
Comm. 582.2: SOLID WASTE REDUCTION FACILITY REQUEST FOR PROPOSAL (RFP
From Finance Director William Takaba, dated January 9, 2006, transmitting a copy of
the Stage 1 Request for Proposals for a Solid Waste Reduction Facility (the Stage 1
RFP). Attaches a published Notice to Offerers which was sent to 120 firms who are
potential vendors on December 28, 2005. The deadline to submit Stage 1 proposals is
February 17, 2006. Explains the County's two step procurement process approach that
will emphasize qualifications and experience. Describes the process for the evaluation
of the Stage 1 RFP's. Also explains the establishment of a Communications Protocol
contained in the Request for Proposals. Requests a presentation in order for the waste
reduction RFP Consultants to bring the Council up to date on the Stage 1 RFP, and to
report on the status of the Stage 2 RFP.
Comm. 582.3: From Finance Director William Takaba, dated January 17, 2006, providing the
Councilmembers with additional information for a better understanding of the purpose
of the Communications Protocol and why it was included in the Stage 1 RFP.
Comm. 582.4: From Council Chair Stacy Higa, dated January 10, 2006, expressing concerns with the
communication protocol (communication with elected ofllcials) contained in
Attachment C of the RFP. Requests the Finance Department provide the specific
requirement in the procurement law which states a communication protoco] is required.
States further that there appears to be a conflict between the communication protocol
and Council business as technology vendors invited to make presentations to the
Council may be disqualified.

JANUARY 15, 2006
From Finance Director William Takaba, dated January 19, 2006, transmitting the
above report.
Comm. 582.6: From Environmental Management Committee (EMC) Chair Oary Safarik, dated
January 30, 2006, stating there is a conflict between Res. 238-02 (Integrated Solid
Waste Management Plan) and Comm. 582.2 relating to the EMC Chair serving as a
member of the Request for Proposal (RFP) Evaluation Committee for the selection of
an Solid Waste Management Facility vendor. Further states that after a conversation
with Finance Director William Takaba, they agreed that an opinion from Corporation
Counsel is warranted.

Submitting Testimony: Those persons wishing to testify in person or by videoconference must register
with the County Clerk's staff. Those testifying in person and submitting written testimony at the
meeting in Hilo should bring sixteen (16) copies of the testimony for distribution at the meeting.
Those testifying by videoconference from the Kona or Waimea Council Offices, should bring one copy
of the testimony. Those persons unable to testify in person or by videoconference may submit
testimony (1) by mail to the County Clerk's Office in Hilo at the above address, (2) by facsimile to
(808) 961-89 ] 2, or (3) by e-mail to counciltestimonyna co.hawaii.hi.us. Copies will be made and
distributed at the meeting when transmitted in a timely manner. In any case, both oral and written
testimony will be made a part of the public record.
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County Clerk within
five days of becoming a lobbyist. {Article 15, Section 2-91.3(b), Hawaii County Code}. A lobbyist
means "any individual engaged for pay or other consideration who spends more than five hours in
any month or $275 in any six-month period for the purpose of attempting to influence legislative or
administrative action by communicating or urging others to communicate with public officials",
subject to specific conditions and exceptions. {Article 15. Section 2-91.3(a)(6), Hawaii County
Code}. Registration forms and expenditure report documents are available at the Office of the
County Clerk-Council, 25 Aupuni Street, Hilo, Hawaii 96720.
