Tyler III [jct3kona@hawaii.rr.com] Sent: Tuesday, February 14, 2006 9:03 AM To: County Council Tx Subject: Reso 254-06 Good Morning, Mr. Chairman and Committee Members: I have reviewed the subject resolution and am very opposed to the sale of 709 square feet of public land in Kailua Village for $25,000, because it is not in the best interests of the public. Let me tell you why this is so. Instead of selling the land in question, the County should grant a long term lease (at a rate to be reviewed at least every ten years) to the entity that owns the encroaching structure. By way of example: assuming a conservative monthly lease rate of $3-$4 per square foot, the monthly lease rent would be between $2127 and $2836 or about $25,500 to $34,00 per year, not counting any future rate increases. The proposed purchase price would be realized in the first yeaz, and continue yearly thereafter, like an annuity. Instead of selling the goose for one golden egg, the County should retain it and reap many golden eggs. The net effect of this will be substantially more revenue with which to serve the people of Kona. You should also be asking yourselves the following questions: 1. Who determined that this waterfront commercial pazcel is "physically and economically unsuitable or undesirable for development or utilization as a separate unit It already has been put to its highest and best use, at no cost to the owner! How could you find a better deal? 2. As for needing an easement to read a water meter, since when does property owner need an easement from anyone else to check one's own property? 3. What does the filing of an SMA have to do with the proposed sale of the land? The encroachment is an improvement which happens to be located in the SMA. As I recall, the question of whether a major or minor permit is required is directly related to tha value of the improvement, not the value of the land. 4. What part of this proposed transaction is in the public interest? I hope you agree with me that this resolution needs to be filed and a new one prepared to facilitate a long term lease with the encroaching owner. Thank you for your consideration of my testimony. J.
