THE GEOTHERMAL ASSET FUND RULES COMMITTEE
Chairperson, members of the Hawaii County Council
The rules governing the administration of the Geothermal Asset
Fund, as mandated by Condition 51 of the Geothermal Resourse
Permit (GRP-2 87) issued by the County Planning Commission and
approved by this Council were specifically required to include
paticipation of Puna residents or representatives thereof. The
Puna community elected the members of the Geothermal Asset Fund
Rules Committee (GAFRC) to comply with this requirement. The rules
that GAFRC came to consensus with the Planning Department about
envisioned volunteer community adjudication of claims at no cost
to the fund and the minimal administration costs of the process
were to be born from the County General Fund leaving the Asset
Fund unencumbered to fulfill its purpose, required by Condition 51
of geothermal impact mitigation. Those rules were never put in`
place. The existing rules have nothing whatsoever to do with the
process as outlined by Condition 51 and therefore are in violation
of Condition 51. The diversion of money away from the mandated
purpose of the fund, for reasons outside the scope of the fund is
deplored by GAFRC as is the continuing violation of the terms of
Condition 51. Please be advised that we regard your actions as
being outside the scope of your charter.
