Per our telephone conversation.
The Regulatory Project Plan for the Hawaiian Municipal Solid Waste (MSW) is as followed:
• APHIS PPO as well as several other staffs are working expeditiously on a proposed rule for the HI MSW
issue.
. An updated generic Pest Risk Assessment (PRA) and a generic Environmental Assessment (EA) which
will include all of Hawaii (now that other Hawaiian Islands are expressing interest) will be published at the
same time as the proposed rule is published for a minimum 60 day public comment period.
• Discussions involving information sharing with the Native Americans have been initiated and will be
ongoing until we finalize the Consultations as mandated by the Executive Order.
Consultations with Fish and Wildlife, EPA, and NOAA National Marine Fisheries are on-going.
. Once the comment period closes on the proposed rule, APHIS will address the comments from the
proposed rule and go out with a final rule.
Site specific EA's for each of the petitioned sites will be published in the Federal Register for a minimum
30 day comment period once the proposed rule becomes final.
. Once the comment period closes for each EA, comments will be addressed and compliance agreements
for each site would be developed.
We do not have a petition from the big island of Hawaii. Some of the questions that we would need to
have answered on company letterhead would be:
Who is the contact person?
What is the process proposed that you would use?
If using a method that uses bales, what contingency plans are in place if a bale is ruptured, how will it be
repaired?
Now much MSW do you intend to move??
Method of movement? Weight and frequency of each movement. Route of movement.
Where to you plan to move the garbage? How will you transport the MSW to this site.
