Higa, Chairperson and Members of the Hawaii County Council Hawaii County Council 25 Aupuni Street Hilo, Hawaii 96720 Re: Operating Budget Presently, the Department of Public Works is in the process of updating and revising Chapter 10 (Erosion and Sedimentation Control) of the Hawaii County Code. This process, however, does not update the existing County of Hawaii Erosion and Sedimentation Control Standards and Guidelines, adopted in December 1975 and that is referenced by Chapter 10, Section 10-26 of the Hawaii County Code. To address this oversight, the Department of Public Works had submitted a grant application to the State of Hawaii Department of Health and has received $44,000 to update and/or revise the County of Hawaii Erosion and Sedimentation Control Standards and Guidelines. The funding will be used to: a) review the existing Standards and Guidelines; b) compare and evaluate the standards and guidelines from other Counties in the State of Hawaii and/or selected municipalities on the mainland; c) prepare an updated report including application of Best Management Practices to different types of projects and settings, and d) incorporate applicable comments by participating committees, agencies into the draft Revised County's Standards and Guidelines. Enclosed is a resolution to authorize the Mayor to enter into a contract for goods and services with the State of 1lawai'i Department of Health. Also enclosed is a bill for an ordinance amending the Operating Budget by appropriating the $44,000 to the Erosion and Sedimentation Control account. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The Department of Public Works is in the process of updating and revising Chapter 10, EROSION AND SEDIMENTATION CONTROL, of the Hawaii County Code. However, the EROSION AND SEDIMENTATION CONTROL STANDARDS AND GUIDELINES, which is in Chapter 10 by reference, also needs to be brought up to date and/or revised inaccordance with current best management practices. The State DOH has provided funds for this effort. As stipulated by Chapter 10, HCC, the standards and guidelines will be adopted pursuant to HRS Chapter 91, Administerative Procedure.
