RE: SHOPO'S POSITION AND CONCERNS ON PROPOSED HAWAII
COUNTY POLICE FLEET IMPLEMENTATION PROGRAMS
Dear Mayor KIM and Chairperson RIGA,
The Hawaii County Police Fleet Implementation Working Group has submitted its
recommendations regarding acounty-owned police fleet program.
As Chairman for SHOPO's Hawaii Chapter and as a member on the County Police Fleet
Implementation Committee, I address this letter to you which I hope will explain the
union's position on this issue regarding any implementation of a fleet program which was
not explained in detail in the Committees Report which was sent to you.
I believe that there are two issues that need to be addressed which were not fully
disclosed to you in the committee's report regarding the union's position on a fleet
program.
First issue is that the union understands the county's authority to move toward
implementation of a Police Fleet Program as long as the rights of our members will be
preserved in accordance with our contract.
The second issue is the implementation of a Fleet Program, if the county should so adopt
the committee's recommendation, the union would have concerns and contract issues that
would have a defmite impact in bringing a fleet program into existence.

I know that the union will offer testimony on this matter when the time comes; therefore
it is my intention to inform you of what I foresee as contract issues that you and the
council should know that may help in making a final decision.
Submitted for your review is a list of such contract issues and concerns:
I. SUBSII3IZED VEHICLE REQUIRED BY POLICE DEPARTMENT
A. As we are aware, a police officer is required to purchase a vehicle to be used
in the performance of his duty and will be given an automobile allowance to
pay for and maintain said vehicle.
B. Under Article 18 of our contract, an officer is allowed to keep his vehicle for eight
years with two one year extensions, far a total often years that he may have his
vehicle in service.
C. Under Article 1, Recognition, there is a need for a mutual consent to changes
regarding any implementation of personnel policies and practices affecting
employee's wages and conditions of work.
II. ISSUE: FLEET IMPLEMENTATION
A. Before any implementation of a fleet vehicle to an officer, the department
could assign an officer a fleet vehicle only after his subsidized vehicle time
limit has expired.
E. Or, if an officer is willing to give up his car allowance and use a fleet vehicle.
C. Attachment "A" is a copy of the SHOPO Group Auto Insurance Record that
reflects the year of a member's vehicle that is being used for police service.
D. The chart is an indicator showing exactly how many vehicles time limit will
expire in what year. In which case, the department would be allowed to issue or
assign a fleet vehicle to an officer.
1. Chart shows that four officers purchased vehicles that are 1996 models, thus
their maximum time limit would be up in 2006.
2. In the event that no officer volunteers to give up their allowance for the
year 2006, only four officers would be placed in a fleet car as well as what
number recraits there maybe.

3. Fleet conversion could take several years as the chart indicates.
COMIliIENTS:
A. The union sees this as perhaps the major factor in any conversion to a fleet
program being that officers under the current subsidized vehicle program
as-was initially required by the- department, have car notes that they are
responsible for and under our contract, would be entitled to receive a
automobile allowance until their vehicles time limit is expired in which case
the department could then place them in a fleet vehicle.
B. The union would be willing to approve on a Supplementary Agreement submitted
by the department, to the union, allowing any officer to forgo his automobile
allowance on a volunteer basis. This will allow an officer to be assigned a fleet
vehicle before the expiration of their time allowance.
III. FLEET PROGRAMS -TAKE HOME -ASSIGNED -POOLED
A. TAKE HOME PROGRAM
1. As indicated in the committee's report, this program comes the closes to
to the current subsidized vehicle program with most of the same advantages
except for off duty time and to and from work time.
This program would take care of any parking problems the department would
have with fleet vehicles.
UNION ISSUES:
A. Union issues regarding this type of program are as follows:
1. The program would have to be on a volunteer basis. Officers can not be
forced to take a fleet vehicle home.
B. The development for policies and procedures for a program, by contract require
Union approval.
IV. ASSIGNED FLEET VEHICLES
A. This program would have the department assign a fleet vehicle to each officer as

the vehicle would be parked at the employees District Station.
UNION ISSUES:
A. Parking would have to be provided for the officer's personal vehicle.
B. Officers would have to be allowed on duty time to transfer equipment
they need during the course of their duty and allowed time to inspect their
assigned vehicle prior to them driving out of the parking lot.
C. In the course of inspecting their vehicle, officers who find that the vehicle
they are to use has a malfunction or a safety problem, the officer would not
be required to use the vehicle for duty.
1. Officer would be allowed to use another vehicle for duty or in the event
there is not one available, assigned to desk duty.
D. The development for policies and procedures for a program, by contract
require union approval.
V. POOLED FLEET
A. Officer would be required to share an assigned fleet vehicle with other officers.
UNION ISSUES:
A. Parking would have to be provided for the officer's personal vehicle.
B. Officers would have to be allowed on duty time to transfer equipment
they may need during the course of their duty and allowed time to inspect their
assigned vehicle prior to them driving out of the parking lot.
C. The development for policies and procedures for a program, by contract
require union approval.

VI. INSURANCE CLAIMS:
A. At present, officers are responsible to provide their own Collision and
Comprehensive Insurance for their vehicles.
B. Attachment "B" is a summary of insurance claims our members had made
during 2004 as a result from being involved in a traffic accident or sustaining
damages to their vehicle other than a traffic accident. Information for 2005 is
not available at this time.
C. Attachment "C" is a copy of insurance rates that the officer pays for coverage.
VII. UNION SURVEY -FLEET VS. SUBSIDIZED
A. The union conducted its own survey in an attempt to answer the question as to
just how its membership feels regarding this issue as well as indicates which
program officers would prefer if given a choice.
B. Attachment "D" is a copy of the survey that was distributed to officers.
C. Attachment "E" are the results from the survey regarding the different
programs and conditions known to the officer at the time of the survey.
SUMMARY
As stated in opening comments, the union understands the county's position regarding a
fleet program as long as the rights of its membership are preserved and there is a clear
understanding of our member's rights in regards to any implementation of a fleet
program.
I have tried to inform you of the pending contractual obstacles that the deparhnent will
encounter with the union and its members in the event there should be a fleet program
adopted.
I am sure that there will be a lot of testimony presented on the pros and cons of The
Implementation of a Fleet Program and understand that the task before you on this topic
will not be an easy one to resolve.

It is unfortunate that I will be off island on January 19, 2006 which is the first scheduled
hearing on this issue and not personally available to answer any questions that the
Council might direct to the union.
However, I will have a union representative available at the hearing, in the event the
council would like to address questions regarding -this report.
